Public Notice

NOTICE IS HEREBY GIVEN that the Calaveras County Planning Commission will conduct a public hearing on May 1, 2008 at 9:00 a. m. to consider possible approval of the following project based upon a Mitigated Negative Declaration. The public hearing will be held in the Calaveras County Board of Supervisors Chambers, Government Center, 891 Mt. Ranch Road, San Andreas, California 2006-182 ZONING AMENDMENT For LAWRENCE SMITH.....


The applicant is requesting a Zoning Amendment to accommodate a Boundary Line Adjustment application involving 2 contiguous parcels (BLA No. 06-101) (Exhibit 2, Boundary Line Adjustment). The Zoning Amendment is to rezone from RR-5 (Rural Residential - minimum 5 acres) to RA-5 (Residential Agriculture - minimum 5 acres) the 0.85 acre adjusted portion of Parcel 2 (APN 068-011-028), and from RR (Rural Residential) to RA-5, the entire 3.56 acre adjusted Parcel 1 (APN 068-011-029). The remaining portion of Parcel 2 would remain unchanged with the RR-5 zoning. The Boundary Line Adjustment would allow the existing winery and the wine tasting facility to be incorporated into the adjusted Parcel 1 with the same proposed zone of RA-5.

The proposed rezone to RA-5 would legalize the existing winery and wine tasting facility, which is currently a non-conforming use. The subject property is located on the north side of French Gulch Road, just west of the intersection with Murphys Grade Road in the Murphy/Douglas Flat Community Plan area.
Pursuant to Section 15072 of the State CEQA Guidelines the County intends to adopt a Mitigated Negative Declarations for the above described project. The review period will begin on March 7, 2008 and end on April 4, 2008. The County will receive comments on the proposed mitigated negative declaration during the review period. All concerned citizens, organizations, and agencies are invited to attend the public hearing or to submit written comments relating to the Negative Declaration and above mentioned projects. Any written comments may be submitted during the public hearing or to the Calaveras County Planning Department prior to the hearing. All project files, staff reports, and negative declarations are available for public review at the Calaveras County Planning Department, Government Center, 891 Mt. Ranch Road, San Andreas, California 95249, during normal business hours from 8:00 a. m. to 4:00 p.m. Copies of the project file, staff report and/or negative declaration can be purchased at the Planning Department for the cost of making the copies.
