Sheriff's Department, County Counsel & Board of Supervisors Resolve Legal Interpretational Differences ~ Sheriff Rick DiBasilio

San Andreas, CA...To the Citizens of Calaveras County; I would like to address the issue recently in the press and community regarding the Calaveras County Sheriff's Office use of funds for the eradication of illegal commercial marijuana growing operations. This Sheriff’s Office is dedicated to following the law regarding the use of funds. We are aware of the concerns raised by the use of certain funds for eradication activities, and have been in useful negotiations to resolve differences in the interpretation of applicable law.

Today, the issues raised have been addressed and resolved by this office, the Board of Supervisors and County Counsel. Any further comments will be discussed at the Board of Supervisors meeting on August 22nd.

Rick DiBasilio, Sheriff

Well, seems like good news though succinct. Interesting that Auditor-Controller Callen according to other news stories is now away until next week.

Auditor Callen scurries away on holiday as the false allegations are resolved in a lawful and professional matter. The sheriffs office should be entitled to ALL of the money collected from the dope growers. Enforce, eradicate, and drive them all out of this county.

I think its great that 2 supervisor the CAO and the Sheriff took it upon themselves to ignore County Counsel and interpret the law to suit them. As long as they are willing to fork out their own money when the growers bring a lawsuit. don't use my taxes for this crap

Lawsuits, ever increasing along with the threats of more by commercial marijuana, are the nail in the coffin of the UO. We simply cannot afford this and must now stop the bleed.

I'd be very reluctant to say we need a new BOS. I say this because the previous board which either quit ,resigned or voted out did a large amount of damage to this county. I certainly hope none of them try to be the "come back kid".

Edson is giving his best best effort to gain the grower's support and voter ability to get back in the cat-bird seat. He created the mess, now he wants to screeeew it up even more? Edson, just stand back and accept you padded envelope.

Clearly the original interpretation of the law was done by the Auditor since she is they one who said the funds were misused. Perhaps a conversation first with county counsel's office before deciding what a law does or does not allow might be in order?

Just because the money was possibly misused doesn't mean the INTENT WAS TO MISUSE IT. This whole industry being legal is new to everyone, including BOS, CAO and other county employees. Before everyone starts jumping to conclusions AND NAME CALLING, maybe our BOS needs to sit down and figure this out. It is not up to the Sheriff to figure this out he is not in charge of the county, he is just a temporary appointed Sheriff, he was never elected by Calaveras county citizens, he was appointed by the BOS to take the late Sheriff Kuntz's place until an election occurred. The Auditor appears to just want to make sure everything is done correctly, per government codes, county code and what the BOS has put in place by the ordinance. BOS do your jobs! quit taking sides hoping to get re-elected and get this straightened out.

Not likely. But -- if you were to test it yourself and find your well tainted, every grower around you (and the associated property owner) are open to litigation. Wanna own A LOT of land around you?

The misspending was criminal, plain and simple. It is not a complicated issue. Nothing new here. Someone should be punished for misusing this money and furthering the corruption this county is so well known for. You can't do whatever you want just because you have a badge.

I second that one, kudos. Look what I also find pretty wild is nothing will ever compare to what other corporate production, greed and mass destruction from logging, mining ,vineyards orchards, industrial pollution ect.ect... We seem to forget about what all this has already done and is still being done to our waters that were sold off many a years ago... but when cannabis comes into play let's blame it on this singular thing. Oh to be blind, oh to be biased old fashioned and spill the propaganda of reefer madness. The you people quotes, the get out dirty dopers, criminal scum. We live in one scary area and it's not due to "dopers" it's due to the strange anger, the old old way of life. Growers don't scare me, these extreme wanna be redneck, flatland transplants with their martinis and vacation homes are more reckless to our way of life. Nosy nancy s, it wasn't always this way. The last 10 to 15 years has changed for the worse by this "I want to live in a quiet rural community and all its glorious beauty" smoke screens and shade pullers. How about we go back to when we were a little more caring towards one another. That would be a nice start. Or the non local yuppies can simply pack up and get out, and the weirdo locals can go out of state as prop.64 pisses them off so terribly. You are the ones that need to shut up and go. The plant is here to stay, regardless of how one feels over commercial growing. And hey I'm not a grower. Fancy that one, but I am in need of work. Like many others, anyone need help round a farm, ect?
