Assault With Deadly Weapon Charges For Intoxicated San Jose Man

Groveland, CA....On Monday, 12/30/13, about 1130 P.M. Deputies were dispatched to the Evergreen Lodge on a report of a stabbing. A Law Enforcement Warden from the California Department of Fish and Wildlife was the first to arrive and witnesses pointed out the suspect, 23 year old, Rogelio Quintero. He detained Quintero until the arrival of Tuolumne County Deputies....


Deputies met with the 19 year old, male victim who had several lacerations on his arm and hand. The victim is an employee of Evergreen Lodge. He was intoxicated but did admit he had been in a physical altercation with the suspect, Quintero. The victim declined to make any other statement regarding the incident. He was treated at the scene for his injuries. The injuries were not significant enough for the victim to be transported to the hospital by ambulance. He will seek medical treatment on his own if needed.

Witnesses told Deputies that Quintero was intoxicated and knocked on the door of an employee housing unit and challenged the people inside to fight. The victim briefly spoke to Quintero and a fight ensued. During the brief physical fight, the victim was cut on the arm. A knife was recovered at the scene. Other employees of the lodge were able to break up the fight and keep the situation under control until Law Enforcements arrival.

The suspect, Rogelio Quintero, was extremely intoxicated. He was placed under arrest for assault with a deadly weapon. He was handcuffed and placed in the rear seat of a patrol car. He then attempted to kick out the side rear window of the patrol car. Quintero was removed from the car by the Fish and Game Warden and a Deputy. His legs were restrained with the use of a restraint hobble and he was transported to and booked into the Tuolumne County Jail.

Due to his level of intoxication he could not provide a statement to Deputies at the scene. On 12/31/13 Deputies attempted to interview Quintero at the jail , but he declined to make a statement. At this time it is unknown if the victim and Quintero knew each other prior to the incident or why Quintero was at the Evergreen Lodge. The investigation is on going.

As of 1/1/14 Quintero was still in the Tuolumne County Jail with bail set at forty thousand dollars.

Charges: 245(A)(1) P.C. Assault with a Deadly Weapon
148(A)(1) P.C. Resisting Arrest

Suspect: Quintero, Rogelio, Apolonio
23 years old
Resident of San Jose, CA
