Calaveras County Supervisors Pass Summer Rental Ordinance

San Andreas, CA...The Calaveras County Board of Supervisors unanimously voted March 26th to establish a permitting system for future summer or transient rentals on Lake Tulloch. This move, requested by besieged residents for years, was passed after four recent meetings over the past 90 days. The current effort to deal with the problem began in the summer of 2011. The Board of Supervisors voted to develop an ordinance in April 2012 in lieu of an initial ban of the practice. The Calaveras County Planning Commission approved the ordinance in November 2012....



The Supervisors voted 3-2 to approve the ordinance which becomes law April 26, 2013. Supervisor Debbie Ponte made the motion to approve the ordinance and was seconded by Supervisor Darren Spellman who has worked with local residents for years to deal with the problem that has plagued the lake for years. Also voting to pass the ordinance was Supervisor Chris Wright.

The move to gain passage of the ordinance involved many past and current board members of Conner Estates, Calypso Bay, Lake Tulloch Shores/Poker Flat, and Copper Cove Homeowners Association plus many members. Critics of the ordinance alleged that the move was sparked by only two property owners. The fact is that there was wide support for the move. In 2011 the Lake Tulloch Shores homeowners voted unanimously to ban short term rents of less than a month.

The ordinance requires all property owners within homeowners associations that do not ban short term rentals to apply for a permit within 90 days of the effective date of the law. The permit fee is being reviewed but Supervisors said it could be about $1,000 the first year and a few hundred dollars or less in future years for renewals.

Property owners with rental contracts for 2013 may continue with the rentals under the previous unregulated environment but must conform in future years. New rentals must operate under the new permitting and regulatory system that limits the numbers of renters and imposes other standards.

Summer or transient rentals have grown over the years at Lake Tulloch primarily spurred by Internet agencies such as Vacation Rentals by Owner. It has become a huge problem since the primarily summer rentals are actually transient rental businesses which inserts hotel like rental businesses into residential communities or neighborhoods. The interests of a vacationer are very different than a family that lives fulltime at a home on Lake Tulloch. The vacationer is at a home to party straight for 6-7 days which impact a neighborhood. Supervisor Debbie Ponte noted that vacationers often move their large boats filled with food and beer purchased at Costco out of town and bypass local merchants.

More and more part time residents are now moving the lake fulltime. This brings more economic growth to the community but the rental of neighboring houses is a disincentive to property owners who want to live full time here. This is a real conflict.

Parking of cars, trucks, motor homes, and trailers created congestion in communities according the Sheriff's office and have become a public safety issue noted one Supervisor. On water congestion occurs too with too many boats parked on docks that simply can't accommodate them. This is all caused by overcrowding of homes. Previously, more than 25-30 renters would crowd into a 4 or 5 bedroom house. This overcrowding is caused by renters pooling together to cover the high rental costs that can range as high at $650 to $850 a night.

The goal of residents who supported the ordinance is to work with homeowners and rental agencies to make the ordinance work and eliminate the conflict. Supervisors have been clear that if these measures don't work tougher measures could be imposed including a ban. The ordinance also notes that no applications will be accepted from homes in HOAs which banned transient rentals.
