Copperopolis, CA....Copper Cove HOA locks out members from the Kiva (a common area) and breaks the law in the process. California Civil Code 1361.5 say’s: Civil Code §1361.5. Association Cannot Deny Owner Access. It reads....Except as otherwise provided in law, an order of the court, or an order pursuant to a final and binding arbitration decision, an association may not deny an owner or occupant physical access to his or her separate interest, either by restricting access through the common areas to the owner's separate interest, or by restricting access solely to the owner's separate interest.....
Kivagate.com is a site set up to petition the board to stop locking out members to common area called Kiva. The members have been asking the board for over a year to give them back the access they had. The HOA has no proof to back up any reason for their illegal actions. The members simply want the ability to come and go off the lake as they choose.
All other HOA’s in the area have 24/7 access to the lake. The board has to power to ignore the wishes of the members and that’s just what they have done. Question: Why do they choose to break the law and why do they get away with it?
