SUMMARY OF THE MINUTES OF A REGULAR MEETING OF THE BOARD OF
SUPERVISORS, COUNTY OF CALAVERAS, STATE OF CALIFORNIA
HELD ON OCTOBER 26, 2010

PRESENT: Merita Callaway, Chair; Thomas Tryon, Vice-Chair; Gary Tofanelli, Steve Wilensky and Russell Thomas, Supervisors; James Jones, County Counsel; Jeanne Boyce, County Administrative Officer; and Carol Gates, Supervising Board Clerk

(On a motion by Supervisor Thomas, seconded by Supervisor Wilensky, agenda items 1 and 2 were approved by a unanimous vote of the Board) 1. MINUTES of a regular Board of Supervisors meeting held on October 5, 2010 2. CORRESPONDENCE: October 8 – 14, 2010
R E G U L A R A G E N D A 3. PUBLIC COMMENTS: Linda Churches, Auditor/Controller, introduced a new member of her staff, Frank DeMattos; announced that Chris Hollingshead will be the assistant Auditor-Controller through December 2010. Michael Wietrick, Rancho Calaveras, spoke regarding specific guidelines for the public participation process relative to the Valley Springs Community Plan update; Kathleen Houle, CalWorks, and Bonnie Newman, Double Springs, submitted copies of a July 2010 IHSS Consumer Story Book, as compiled by the California IHSS Consumer Alliance; Andy Ballentyne, District 5, spoke regarding equal time for public comments; regarding the Valley Springs Community Plan emphasized that the people are the determining factor, not outside groups. Kelly Gruesch, Program Director/Resource and Referral/The Resource Connection, referred to the elimination of Stage III Child Care Funding in the State Budget and the impact it will have on this County; they are looking for alternative funding; announced that funding for the local Child Care Planning Council has been reduced by 50%; Peter Racz, Rancho Calaveras, spoke regarding the need for County and Government code compliance and accountability relative to salaries, benefits, financial reports, etc. Terry Baker, Rail Road Flat, submitted a letter of request for clarification/explanation regarding the rezoning of property; referred to the celebrated rooster war of Calaveras County. Bonnie Newman, Double Springs, spoke on the topic of struggling - struggling every day as a home care provider - and struggling with the home care program. Marti Crane, Valley Springs, spoke of staying informed and the need to celebrate the good things that help to make Calaveras the place where we chose to live and raise our families; referred to the Valley Springs Community Plan that was presented to the Board as representing the combination of extensive outreach; made reference to the public comment process. 4. Discussion and possible action re: MINUTE ORDER authorizing the Board Chair to execute a Notice of Non-Renewal for California Land Conservation Contract No. 233 – Mattson; Environmental Management/Agriculture (cont’d from 10/5/2010) – motion made to take no action at this time; approved 5-0 5. Discussion and possible action re: MINUTE ORDER approving request for Prequalification of General Contractors Seeking to Bid on the Calaveras Adult Detention Facility and Sheriff’s Administration Building document; – approved 5-0 6. Discussion and possible action re: MINUTE ORDER authorizing the Board Chair to sign a Ground Lease, Grant of Utility Access Easement, and Right of Entry for Construction in connection with the Calaveras Adult Detention Facility and Sheriff’s Administration Building; – approved 5-0 7. Discussion and possible action re: MINUTE ORDER adopting budget cover for fiscal year 2010-11; – A majority of the Board selected a photo of a Veterans Day Flag Ceremony. 8. Discussion and possible action re: RESOLUTION authorizing discharge of accountability to clear outstanding amounts in accounts receivables; – approved as amended, 5-0 9. Discussion and possible action re: selection of members of the Board of Supervisors to represent Calaveras County on the California State Association of Counties (CSAC) Board of Directors; – Motion made to continue the selection of a new CSAC representative and alternate until such time appointments of Board members, as representatives to various agencies, are made in January 2011; and forward a letter to CSAC stating that our current primary representative, Supervisor Callaway, and alternate, Supervisor Thomas, will continue in place until said appointments are made; approved 3-2; Noes: Supervisors Callaway & Wilensky 10. PUBLIC HEARING and possible Board action re: RESOLUTION approving the Road Impact Mitigation (RIM) Fee Program Annual Report and reaffirming the Capital Project List; Public Works – approved 5-0 11. Review of correspondence, reports and various matters of concern. Supervisor Wilensky explained the process by which 24 square miles in District II, including the areas of Rail Road Flat, Glencoe, West Point and Wilseyville were rezoned from unclassified to other zonings; this week will attend an Amador/Calaveras consensus meeting on forestry; a Sierra Nevada Conservancy conference call; Wednesday, a Fish & Game sponsored floating island tour at the Garamendi Ranch; Friday, a Calaveras Mariposa Community Action Agency meeting in Coulterville. Supervisor Tryon had nothing to bring before the Board at this time. Supervisor Tofanelli, this evening and tomorrow evening, will attend FEMA map meetings at the San Andreas Town Hall; Wednesday the floating island tour; Friday, the Calaveras Mariposa Community Action Agency meeting in Coulterville. Supervisor Thomas will attend the FEMA map meetings at the Town Hall; Wednesday, a ribbon cutting ceremony at the Jenny Lind Fire Protection District in celebration of the completion of the DaLee/Cassidy Water System; and Wednesday the floating island tour at the Garamendi Ranch. Supervisor Callaway, on Wednesday will attend the floating island tour; in reference to a discussion last week clarified that Board correspondence is available to the public in the County Clerk’s Office and at Board meetings; tomorrow a Treasury Oversight meeting, a Juvenile Justice meeting; tomorrow a meeting with Brian Moss and a member of the public; Friday, will be involved with the Halloween event at Government Center; referenced her attendance at a Calaveras Public Power Agency meeting – they agreed to reduce the Power Revenue Requirement (PRR) and CPPA’s percentage PRR obligation from previous estimates. Jeanne Boyce, County Administrative Officer, announced an invite from CCWD to attend the DaLee/Cassidy Water System event; referenced the receipt of a letter from the Department of Housing and Community Development – the County has been awarded a 2010/2011 Community Development Block Grant in the amount of $478, 375 – this will provide funding for the Food Bank, Mother Lode Job Training and CalWorks; announced that there will be a General Plan update study session on November 9, 2010 at 1:30 p.m.; informed that the loans the Board approved for Area 12, Mother Lode Job Training and the Central Sierra Planning Council are no longer needed; spoke of the Governor signing a $10,000,000 bill for the Williamson Act Subvention Program; announced that the Governor vetoed SB 866 – the mandate securitization program. Counsel Jones has nothing to report at this time. 12. A CLOSED SESSION was held: pursuant to Government Code section 54956.9(c); conference with legal counsel; anticipated litigation – initiation of litigation; (one case); – resulting in nothing to report. 13. A STUDY SESSION was held: Discussion and Board direction – The Water Enhancement Program: An analysis of the costs required to transfer the title of the original five (5) water tenders to the Fire Protection Districts; Administration
