SUMMARY OF THE MINUTES OF A REGULAR MEETING OF THE BOARD OF SUPERVISORS
COUNTY OF CALAVERAS, STATE OF CALIFORNIA
HELD ON OCTOBER 5, 2010
PRESENT: Merita Callaway, Chair; Thomas Tryon, Vice-Chair; Gary Tofanelli, Steve Wilensky and Russ Thomas, Supervisors; James Jones, County Counsel; Jeanne Boyce, County Administrative Officer; and Madaline Krska, Deputy Clerk

C O N S E N T A G E N D A
(On a motion of Supervisor Wilensky and seconded by Supervisor Tofanelli, the consent agenda was approved by a unanimous vote) 1. MINUTES of a regular Board of Supervisors meeting and FY 2010/2011 Final Budget Hearings held on September 14, 2010. 2. CORRESPONDENCE: September 17-23, 2010 – approved as processed 3. MINUTE ORDER authorizing the Health Services Agency Director to: 1) sign the agreement with the California Department of Public Health, Emergency Preparedness Office for Public Health Emergency Preparedness funds, in the amount of $192,092 for the period July 1, 2010 – August 9, 2011; and 2) sign amendments to the agreement and other required certification forms and reports. 4. RESOLUTION approving a revised and extended contract with Calaveras County Public Safety Employees Association (CCPSEA) for July 1, 2010 to September 30, 2011. 5. RESOLUTION accepting a $1,250,000 grant award from the USDOJ Cops Technology Grant Program for the purchase and installation of public safety communications equipment and microwave infrastructure. 6. RESOLUTION recognizing October 2010 as Domestic Violence Awareness Month. 7. MINUTE ORDER authorizing a short-term no-interest loan to Area 12 Agency on Aging until the State adopts a FY 2010/11 budget and funding resumes. 8. MINUTE ORDER approving the cancellation of Board of Supervisors meetings scheduled for November 23, 2010 and December 21 & 28, 2010.

9. PUBLIC COMMENTS: Frank Ginger commended the County for the clean up of the Wilseyville Transfer Station. Concern was stated for a building on that property that has been vandalized and is now a serious fire threat. Peggy Rourke-Nichols, addressed the Board regarding her severe allergic condition to latex. Documentation was submitted to the Board regarding this health care issue stating the Symptoms and other aspects of the health care condition. October 3-9 is National Latex Allergy Awareness Week. The Sheriff’s Department uses latex gloves and accommodated her allergic sensitivity when her vocation required finger prints. Certifications of appreciation were given to Kendra and the entire Sheriff’s Dispatch Center. Marti Crane, Valley Springs, Rancho Calaveras, referenced a copy of the West Point News regarding a group of organizations that are working to save our forests. A report was given on Mark Twain St. Joseph Hospital’s Health Fair that provided a variety of immunizations and tests. The hospital sponsored the first Valley Springs “Pink in the Night” in recognition of Breast Cancer Awareness Month. Ms. Crane asked for support for her and her husband’s participation in Dancing with the Sierra Stars. Public encouragement was given to attend the Angels Camp City Council meeting today and the CCOG meeting tomorrow. Barbara Hendrycks, Mokelumne Hill, read into the record concerns regarding loss in television and radio reception in their home. An investigation to determine the reason for this situation was requested. The concern for the ability to receive emergency notices was stated. Bonnie Newman, Double Springs, reported on the success last week for contributions to pay for the purchase of stamps. Due to this funding all Calaveras providers were sent an updated calendar and resource list. IHSS does not send this information to the providers. Terry Baker, Rail Road Flat, submitted documentation into the record. Reference was made to comments made by him last week regarding attacks by animals and their owner’s relationship with the animal. A recording of an interview was played regarding a woman who is impacted by her neighbor having several horses on her property. Concerns were stated for peoples rights being ignored. Bill Schmiett, Mountain Ranch, presented a progress report on his 2007 application for a Tentative Parcel Map on property in Copperopolis. Other agencies involvement and timelines were outlined including Fish and Game. Concerns were stated for the level of progress of the project and asked for some assistance. Ed Ballard, Captain, Sheriff’s Department, gave a progress report regarding the attack by a dog in Mountain Ranch. After the Domestic Animal Advisory Committee meeting on the 14th more information will be provided. Recommendations will be made for additional codes in the County ordinances that will provide more strength in handling stray dogs and the enhancement of what conditions would permit seizure of an animal. 10. Discussion and possible action re: RESOLUTION establishing Proposition 4 Fiscal Year appropriations limits for the County of Calaveras for Fiscal Year 2010/11. Approved 5-0 11. PUBLIC HEARING and possible Board action re: 2006-189 Zoning Amendment and Tentative Parcel Map for John and Michele Rugo: amend the zoning from Unclassified to General Agriculture for two parcels. In conjunction with zoning amendment, a Tentative Parcel Map to create three parcels of approximately 158+ total acres. The subject property is located on Sheep Ranch Road, approximately 2.5 miles north of Murphys. Approved 4-1; NOES: Tryon 12. Discussion and possible action re: MINUTE ORDER authorizing the Board Chair to execute a Notice of Non-renewal for California Land Conservation Contract No. 233 – Mattson; continued to October 26, 2010 13. Discussion and possible direction regarding alternatives for access road alignment to the new Calaveras Criminal Justice Center. No action taken, the preferred option was approved on September 21, 2010. 14. Discussion and possible action re: MINUTE ORDER authorizing a short-term no-interest loan to Mother Lode Job Training until the State adopts a FY 2010/11 budget and funding resumes. Approved, as modified, 5-0 15. Review of correspondence, reports and various matters of concern. Supervisor Thomas requested a Board member attend the Central Sierra Economic Development Council conference in his place as he has a scheduling conflict. Supervisor Tofanelli will attend this meeting. Supervisor Thomas reported on an Upper Mokelumne River Watershed meeting he attended last week for Supervisor Tofanelli. Supervisor Tryon will attend a CCOG meeting on Wednesday. Supervisor Tofanelli Wednesday will attend the Central Sierra Economic Development Council conference and will attend the Law Library meeting for Supervisor Callaway and the CCOG meeting in the evening. Supervisor Wilensky will attend a Mental Health Advisory Board meeting this afternoon; Wednesday a conference on mining and Thursday a NACo water meeting. Discussion was held regarding correspondence from NACo nominating Supervisor Wilensky to be on Public Lands Committee this year. Affirmation for this appointment was given. Wilensky reported on the Amador Planning Commission meeting regarding the Buena Vista co-gen biomass project. The hope is to have the project on line by late February. Supervisor Callaway will attend CSAC Executive Committee meetings this week. This week-end is a “Tough Mudders” event at Bear Valley bringing to the County many visitors. Jeanne Boyce, CAO reported on discussions held last week regarding the state budget regarding: spending cuts, sales tax, increased revenue, sale of 11 state buildings, SEIU and repeal of a law passed in 1999, rainy day funds, no tax increase, elimination of discussion to more state prisoners to local jails, Vehicle License Fees revenue dedicated to law enforcement. James Jones, County Counsel had nothing to report. 16. A CLOSED SESSION was held: pursuant to Government Code section 54956.9: conference with legal counsel re: existing litigation - (three cases) Michael Nemee and Michelle Nemee v. County of Calaveras, Calaveras Superior Court Case No. CV35775; Michael Nemee and Michelle Nemee v. County of Calaveras, Calaveras Superior Court Case No. CV35721; Michael Nemee and Michelle Nemee v. County of Calaveras, Calaveras Superior Court Case No. CV36297 – resulting in nothing to report.
