SUMMARY OF THE MINUTES OF A REGULAR MEETING OF THE BOARD OF
SUPERVISORS, COUNTY OF CALAVERAS, STATE OF CALIFORNIA
HELD ON SEPTEMBER 28, 2010
C O N S E N T A G E N DA
(On a motion of Supervisor Thomas and seconded by Supervisor Wilensky, consent agenda items 1 thru 3 and 5 thru 9 were approved by a unanimous vote. On a motion of Supervisor Thomas and seconded by Supervisor Tofanelli agenda item #4 was unanimously approved.) 1. MINUTES of a regular Board of Supervisors meeting held on September 7, 2010 2. CORRESPONDENCE: September 10-16, 2010 – approved as processed 3. RESOLUTION approving the transfer of $5,000.00 on May 31, 2010 from the Community Development Block Grant (CDBG) Revolving Loan Fund into the Rental Security Deposit Account (RSDA); and a RESOLUTION approving the end of year transfer of $3,940.77 excess funds from the CDBG RSDA to the CDBG Revolving Loan Housing Rehabilitation Deposit Fund for the purpose of meeting the on going needs of the program and State CDBG policy 4. MINUTE ORDER authorizing the Auditor/Controller to release by warrant to the Resource Connection for the support of the Domestic Violence Shelter-Based Program in Calaveras County the Domestic Violence Education and Training Fund Probation/Court collections, in the amount of $15,497.68 and the Pressley Funds collected July 1, 2009 through June 30, 2010, in the amount of $3,971.53 5. RESOLUTIONS (5) authorizing the non-renewal of portions of California Land Conservation Contract Nos. 5, 41, 45, 101 and 115 6. MINUTE ORDER approving amendment to the agreement between PSA Dewberry and Calaveras County in the amount of $69,450 for Professional and Specialized Services related to the design and facilitation of furniture bid package for the new Adult Detention Facility and Sheriff’s Administration Building 7. RESOLUTION establishing Ad Valorem Property Tax Rates for Fiscal Year 2010-2011 8. MINUTE ORDER approving a contract between American Legion Ambulance Post #108 and the Calaveras County Sheriff’s Office for emergency medical dispatch services in Calaveras County for the period of July 1, 2010 to June 30, 2015 9. MINUTE ORDER approving a contract between Ebbetts Pass Fire District and the Calaveras County Sheriff’s Office for emergency medical dispatch services in Calaveras County for the period of July 1, 2010 to June 30, 2015
R E G U L A R A G E N D A 10. PUBLIC COMMENTS: Alan Fowler, Mountain Ranch, spoke of the killing of Jerry Yates; referred to a massive public outcry against vicious dogs and an action plan informing residents of critical points of the animal control law, penalties for violations and a policy for follow up on vicious dog violators; submitted a letter on behalf of Mountain Ranch residents expressing concerns and suggestions. Terry Baker, Rail Road Flat, referred to an ongoing illegal cock ranch operation; voiced concern of dogs owned by Susie Coe; submitted a map of the Coe property. Kelly Fraguero, speaking on behalf of the Resource Connection and the Calaveras Crisis Center, gave an update of committee activities, referred to Santa’s Express, the community garden groundbreaking ceremony, the Court Legal Help Center, announced that October is Domestic Violence Awareness Month. Al Segalla, Calaveras County Taxpayer’s Association, submitted a copy of a letter sent to Governor Schwarzenegger in support of reducing taxes by reducing the size of State Government; referred to Prop 25 on the November ballot as removing constitutional protections against over taxation; urged the passage of a “Fiscal Responsibility Amendment”. Marti Crane, Rancho Calaveras, referred to a discussion last week regarding a Joint Powers Agreement (JPA) with the Calaveras Council of Governments (CCOG); spoke of all as having a vested interest in government; emphasized the importance of being informed of and having product quality and quantity time to evaluate and comment. Bonnie Newman, Double Springs, referred to newspaper articles involving fraud in home health care cases; submitted calendars for home care providers and recipients along with a County resource list of providers; spoke of attending an IHSS Committee meeting last week and asking for assistance in mailing the resource list. 11. Discussion and possible action re: RESOLUTION proclaiming October as National Breast Cancer Awareness month in Calaveras County; approved 5-0 12. PUBLIC HEARING for consideration of purpose of soliciting citizens’ views regarding the transfer of funds from the Community Development Block Grant (CDBG) Revolving Loan Account (RLA) to the Rental Security Deposit (RSD) Program RLA, in the amount of $24,000; and approval of a RESOLUTION in conjunction therewith; approved 5-0 13. Discussion and possible action re: RESOLUTION authorizing boundary line adjustment 09-30 for the Dewey Fischer Family Trust; approved 5-0 14. Discussion and possible action re: MINUTE ORDER authorizing the Chair of the Board of Supervisors to sign the agreement with JDT Consultants, Inc. for the provision of therapeutic behavioral services, in an amount not to exceed $100,000 for the period July 1, 2010 thru June 30, 2011; Behavioral Health; approved 5-0 15. Discussion and possible action re: RESOLUTIONS (4) approving FY 2010-2011 Adopted Budgets as follows: 1) RESOLUTION adopting Fiscal Year 2010-2011 Adopted Budget for the County of Calaveras; approved 5-0 2) RESOLUTION adopting Fiscal Year 2010-11 Adopted Budgets for Districts Governed by the Board of Supervisors; approved 5-0 3) RESOLUTION authorizing the purchase of certain capital assets at Fiscal Year 2010-2011 Adopted Budget; approved 5-0 4) RESOLUTION authorizing changes to the Calaveras County Position Control List Adopted Budget Year 2010-2011; approved 5-0 16. Discussion and possible action re: RESOLUTIONS (2) approving FY 2010-2011 Adopted Budgets for the Air Pollution Control District as follows: 1) RESOLUTION whereby the Calaveras County Air Pollution Control District Board adopts the Fiscal Year 2010-2011 Adopted Budget for the Air Pollution Control District – approved 5-0 2) RESOLUTION whereby the Calaveras County Air Pollution Control District Board appoints the Environmental Management Agency Administrator as the Air Pollution Control Officer; approved 5-0 17. Discussion and possible action re: RESOLUTION whereby the Calaveras County In-Home Supportive Services Public Authority Board adopts the Fiscal Year 2010-2011 Adopted Budget for the In-Home Supportive Services Public Authority; approved 5-0 18. Review of correspondence, reports and various matters of concern. Supervisor Tryon reported on his attendance last week at the annual RCRC meeting; Supervisor Wilensky, this evening will attend a meeting of the Amador County Planning Commission for a review of the EIR Co-Generation plant in Buena Vista; Wednesday morning will attend a meeting in Sonora of the Senior Employment Program related to Mother Lode Job Training followed by a meeting of the Mother Lode Job Training Board; Thursday morning a Central Sierra Child Support meeting in Jackson to discuss moving Tuolumne County into the JPA; following that afternoon, a Mental Health meeting to discuss the receipt of a $100,000 grant; Friday, a 1st Five Commission meeting; will be missing the Pardee BBQ; asked for a Board member to substitute for him at a Upper Mokelumne River Watershed Authority meeting that morning as he will be hosting the Encourage to Change Program; Monday afternoon a 1st Five Calaveras meeting at the CalWorks Sequoia Room; Darren Spellman, Rancho Calaveras, spoke of the possibility of generating revenue from green waste; Marti Crane, Rancho Calaveras, announced an October 5, 2010 Angels Camp City Council meeting at the Murphys Fire Station on Highway 49; and a CCOG meeting in Board Chambers on Wednesday, October 6, 2010 at 6:30 p.m; Supervisor Tofanelli, on Friday will attend the Pardee BBQ and the Upper Mokelumne River Watershed Authority meeting; this weekend a Valley Springs Fashion Show at the Vet’s Hall, a fundraiser for the Barn Building Committee for the new Community Center; referenced a meeting he attended last Thursday at the Valley Springs Elementary School; Supervisor Thomas, spoke of his attendance at last Thursday’s meeting at the Valley Springs Elementary School; will participate in the Valley Springs Fashion Show this weekend; pointed out to District 5 residents his participation in an online interview with Candidate Spellman; a Valley Springs News Candidate Night next Monday at the Rancho Calaveras Club House; and on Wednesday, October 6, 2010 a District 5 Candidates Night in Copperopolis at the Armory; will attend the Pardee BBQ this Friday. Supervisor Callaway asked that a Board member attend the Arnold Clinic Lighting Ceremony on Thursday evening – Supervisor Tryon will attend; Callaway will be out of town and unable to attend a Law Library meeting next Wednesday – Supervisor Tofanelli will attend on her behalf; requested Board attendance at an October 27, 2010, at 4:00 p.m. event - the Calaveras Fish and Game Commission will be having a field trip to The Floating Island West, on the Garamendi Ranch, to view manmade systems that mimic natural occurring wetlands – they are made in Calaveras County out of re-cycled plastic. CAO Boyce spoke of the lack of a State Budget; Counsel Jones may attend the Valley Springs Fashion Show. 19. A CLOSED SESSION was held: pursuant to Government Code section 54956.9: conference with legal counsel re: existing litigation; Ray Waller v. Board of Supervisors of Calaveras County, et al; Calaveras Superior Court Case No.: CV35737 – resulting in nothing to report. 20 CLOSED SESSION: pursuant to Government Code section 54956.9; conference with labor negotiators; CCPSEA – Director Human Resources and Risk Management – Board action: item pulled from the Agenda 21. A CLOSED SESSION was held: pursuant to Government Code section 54956.9(b)(1); conference with legal counsel; anticipated litigation – significant exposure to litigation (1 case) – resulting in nothing to report.
