Dear Supervisors, A Mr. Sherman from San Andreas spoke about the U.S. Constitution before the Board of Supervisors on 8/24. While his ignorance could usually be dismissed as common, it was instead outrageous because he directed those who disagree with him to "go back" and do "research" after he had just butchered the document. So here's setting the record straight on the subject...
Mr. Sherman said the U.S. Constitution "guarantees our rights to life, liberty and the pursuit of happiness", which is only partially true. Life and liberty yes, in the 5th and 14th Amendments. "Pursuit of happiness" is not mentioned in the Constitution anywhere, but rather in the Declaration of Independence. He then claimed the U.S. Constitution "does not speak to property rights at all," however property rights are also mentioned in the 5th Amendment, which guarantees we're not to be "deprived of... property, without due process of law; nor shall private property be taken for public use, without just compensation." (the 14th Amendment then places the due process of law restriction on the States) Which begs the question, did Mr. Sherman even read the U.S. Constitution before making such blatantly false statements about it publicly? If he did, how did he miss the 5th Amendment? I hope you knew these to be false statements at the time you heard them; I knew it immediately. If you didn't, then I encourage you to review the document you took an oath to uphold.
It is imperative that falsehoods about our "Supreme Law of the Land" be corrected with immediacy if it's to remain the law of the land.
