SUMMARY OF THE MINUTES OF A REGULAR MEETING OF THE BOARD OF SUPERVISORS
COUNTY OF CALAVERAS, STATE OF CALIFORNIA
HELD ON JULY 20, 2010


PRESENT: Merita Callaway, Chair; Thomas Tryon, Vice-Chair; Gary Tofanelli, Steve Wilensky and Russ Thomas, Supervisors; James Jones, County Counsel; Jeanne Boyce, County Administrative Officer; and Madaline Krska, Deputy Clerk
ABSENT: None
CONSENT AGENDA
The consent agenda was approved unanimously with agenda item #5 continued to July 27, 2010
1. MINUTES of a regular Board of Supervisors meeting held on June 22, 2010 2. CORRESPONDENCE: July 2 – 8, 2010, as processed 3. RESOLUTION approving the submittal of the Oil Payment Program applications to the Department of Resources Recycling and Recovery (CalRecycle) through Fiscal Year 2014/2015 4. RESOLUTION approving agreement between Calaveras County and Brad Sutton Trucking for commercial truck hauling for the Proposition 1B Program, for an amount not to exceed $372,000, over a period of one year from July 20, 2010, and be renewable on a year-to-year basis up to three (3) years ending July 20, 2013 5. RESOLUTION accepting California Multiple Award Schedule (CMAS) quotes and authorizing purchase of a D6T XL Tractor, in the amount of $379,616.25 continued to July 27, 2010 6. RESOLUTIONS (3) consolidating Schools, City of Angels and Mark Twain Health Care District Elections with the November 2, 2010 General Election REGULAR AGENDA 7. PUBLIC COMMENTS: Mike Wietrick, Vice-Chair for Valley Springs Community Plan, will submit the plan at the July 26th Board meeting. Wietrick feels the draft plan is a compilation of communication from many community members. The document is available this week for public review. Gary Caldwell, Valley Springs, referenced his comments during a prior meeting for the Board to avail themselves of County Counsels’ advice regarding agenda item decisions. Caldwell would like County provided Ombudsmen services for County processes. Caldwell is willing to work with staff to pursue federal grants for this position. Jim Turley, SEIU/President, expressed concerns for lack of communication between the bargaining teams. Turley summarized the union’s offer for savings and reinstatement of 2.5 positions. No formal offer has been presented by the County and Turley asked for individual Board members consideration. Bonnie Newman, Double Springs, related stories regarding mining from her youth. Terry Baker, Rail Road Flat, submitted documentation into the record regarding his neighbor’s poultry operation and the coops that have been constructed. Baker referenced members of the Agriculture Dispute advisory Board. 8. INFORMATIONAL ITEM-update on the Calaveras County Positioning Public Child Welfare Guidance Institute Team. 9. Review of correspondence, reports and various matters of concern: Supervisor Tryon had nothing to report; Supervisor Tofanelli on Wednesday will attend the Calaveras Mariposa Community Action Agency and Parks and Recreation meetings, Thursday will attend a Juvenile Justice meeting for Chair Callaway and Friday an Upper Mokelumne River Watershed meeting; Supervisor Wilensky today, will attend a Forest Leadership Council meeting, Wednesday will attend Sierra Nevada Conservancy, Amador Calaveras Consensus and Parks and Recreation meetings, Thursday a Juvenile Justice meeting and Friday an Upper Mokelumne River Watershed meeting; Supervisor Thomas reported on his attendance at a LAFCO meeting; Chair Callaway this week, will attend the following meetings; Park and Recreation Commission, Calaveras Public Power Agency, homeowners and rotary. Chair reported AB 811 is temporarily off the table; Chair Callaway initiated discussion regarding directing County Counsel to draft an ordinance allowing the Board of Supervisors to meet in other locations. A poll of the Board determined Supervisor Tryon the only negative. Direction was given to Counsel Jones to prepare an ordinance. CAO Boyce had nothing to report; County Counsel Jones had nothing to report. 10. CLOSED SESSION: pursuant to Government Code section 54956.9; conference with labor negotiators: SEIU, DSA, CCPSEA – Director Human Resources and Risk Management was cancelled 11. CLOSED SESSION: pursuant to Government Code Section 54956.9: conference with legal counsel re: existing litigation; Ray Waller v. Board of Supervisors of Calaveras County, et al; Calaveras Superior Court Case No.: CV35737 resulting in no action taken 12. STUDY SESSION to discuss a proposed update to the Joint Powers Agreement (JPA) between Calaveras County, City of Angels Camp and Calaveras Council of Governments (CCOG)
