Leslie Davis & Layoff Notices Highlight Board of Supervisors Meeting~ With Summary & Video for Tuesday May 18th, 2010

San Andreas, CA....The Calaveras County Board of Supervisors Meeting weighed in as a respectable 3 1/2 hours yesterday. The events that highlighted the meeting were allegations of Tax Fraud against County Acting Assessor Leslie Davis and in a closed session the Board voted that layoff notices for this budget cycle can go out. Their vote clears the way for the Human Resources & Department Heads to inform the county employees that are on the short list this year. part of the public record on his allegations of misconduct by acting Assessor Davis. The Supervisors have pushed the matter on to the Board of Equalization. After Mr. Ellis spoke during public comments Davis responded to the accusations during the meeting yesterday. This portion of the meeting started about 6 minutes into the meeting. Her claim is that it was personal property that was included in the sale that provided the discrepancy between the purchased price of her home in the Valley Springs area and what the assessed value is. The allegations have centered around was it allowable for her home to be valued less than the purchase price for tax reasons in light of Prop 13, stipulations.

HELD ON MAY 18, 2010

PRESENT: Merita Callaway, Chair; Thomas Tryon, Vice-Chair; Gary Tofanelli, Steve Wilensky and Russell Thomas, Supervisors; James Jones, County Counsel; Jeanne Boyce, County Administrative Officer; and Carol Gates, Supervising Board Clerk

1. MINUTES of a regular Board of Supervisors meeting held on April 27, 2010
2. CORRESPONDENCE: April 23-29, 2010, as processed
3. RESOLUTION authorizing the purchase of a Ricoh MPC 5000 Multifunctional printer, in the amount of $17,375, a capital asset, to replace a failing printer in the Planning Department alone with a BUDGET ADJUSTMENT from the duplication designated fund .
4. RESOLUTION allowing for contractual agreement between Calaveras County and El dorado County for the use of four (4) juvenile hall beds.
5. MINUTE ORDER authorizing Chair to sign a one year lease with Tom Furnanz, Doug and Mary Munnecke and Nancy Shaw for space at 426 North Main Street, Angels Camp for the Angels Camp Library, effective July 1, 2010, for a rent of $900 per month.
6. MINUTE ORDER authorizing Board Chair to sign Annual Work/Financial Plan 10-73-06-0249-RA between USDA/APHIS – Wildlife Services and Calaveras County for Fiscal Year 2010-2011.
7. MINUTE ORDER authorizing Board Chair to execute an agreement between California Department of Social Services and the County of Calaveras to accept grant funding for the Child Abuse Prevention, Intervention and Treatment Act Program, Child Protective Services – Citizens Review Panel, for the period July 1, 2009 through June 30, 2012, in the amount of $75,000.
8. MINUTE ORDER authorizing mid-year technical budget adjustments.
9. MINUTE ORDER authorizing the County Administrative Officer, upon recommendation of the Calaveras County Parks and Recreation Committee and the District Supervisor to reallocate unspent Proposition 40 Per Capita Grant Project Funds to previously established per capita projects.
10. MINUTE ORDER approving the execution of a one (1) year extension of the lease agreement between County of Calaveras and Julia Moore, Donald Myers and Marcia Meyers for the West Point Library, located at 291 Main Street at $540.75/month for the period of July 1, 2010 to June 30, 2011.
11. MINUTE ORDER authorizing the distribution of $1025 from the District 5 Board Project Fund: $250 to Copperopolis Community Center for their historical preservation efforts; $400 to the Copperopolis Parks and Recreation Committee for their kids summer camp project; and $375 to the Valley Springs Boosters for expenses associated with the 2010 community fireworks display.
12. MINUTE ORDER authorizing the distribution of $1000 from the District 1 Board Project Fund: $250 to the Snyder’s Pow Wow for Native American demonstrations; and $750 to the Valley Springs Boosters for expenses associated with the 2010 community fireworks display.
13. PUBLIC COMMENTS: Jon Ellis, Arnold, CA announced that he has formally filed a complaint with the Fair Political Practices Commission re: the matter of Leslie K Davis on allegations of tax fraud, based on public records and what he considers clear law.
Leslie Davis/Acting Assessor and speaking today as a private citizen, responded to comments of Jon Ellis by stating that his allegations of tax fraud are vicious and unfounded.
Les Martin, Valley Springs, CA requested clarification of a May 4, 2010 agenda item re: discharge of accountability to clear outstanding aid of general assistance repayments for cases that are declared uncollectable.
Mary Sawicki, CalWorks Director, along with Supervisors Tryon, Thomas Wilensky and Callaway responded to Les Martin re: discharge of accountability.
Bonnie Newman, Double Springs, CA referenced her attendance at a union meeting relative to home health care providers; shared a personal story of a life changing experience.
14. Review of correspondence, reports and various matters of concern: Supervisor Tofanelli will meet with Planning this afternoon re: the Valley Springs Community Plan update; Friday a Calaveras/Mariposa Community Action Agency meeting in Coulterville; tomorrow evening a Park & Recreation Commission meeting in San Andreas to discuss a soccer field for District I; referred to various meetings attended last week re: his trip to Washington DC to lobby for funding. Supervisor Wilensky will attend a Calaveras/Amador Consensus meeting tomorrow morning followed that afternoon by a Sierra Nevada Conservancy meeting in Jackson re: the sustainable sierra forest initiative; Friday, a Calaveras/Mariposa Community Action Agency meeting followed that afternoon by a Central Sierra Family Support meeting; Monday, a Multi Jurisdictional meeting at Mark Twain St. Josephs Hospital; reference various meeting he attended last week while in Washington DC lobbying for federal funding. Supervisor Tryon will attend a meeting with COG next Tuesday at the Bret Harte Theater re: the Wagon Trail Project. Supervisor Thomas spoke of his attendance last week at the County Fair; referenced a water line slated for various Rancho Calaveras property owners; Tom Garcia, Public Works Director, reported on inspection fees relative to trenching in road ways for water lines; Supervisor Callaway spoke of attending the County Fair last week and working at the Solid Waste Task Force booth; Friday will attend a Central Sierra Child Support meeting; Jeanne Boyce reported on the Governor’s May revise; Counsel Jones had nothing to bring before the Board at this time.
15. STUDY SESSION was held to review the status of the Park and Recreation Master Plan with focus on governance and finance.
16. CLOSED SESSION: pursuant to Government Code section 54956.9; conference with labor negotiators: SEIU, DSA, CCPSEA – Director Human Resources & Risk Management – resulting as follows: By a unanimous vote, the board authorized the Human Resources Director to proceed with issuing employee layoff notices.
17. CLOSED SESSION: pursuant to Government Code section 54956.9(b)(1); conference with legal counsel; anticipated litigation – significant exposure to litigation (one case) – resulting in nothing to report.
