SUMMARY OF THE MINUTES OF A REGULAR MEETING OF THE BOARD OF SUPERVISORS
COUNTY OF CALAVERAS, STATE OF CALIFORNIA
HELD ON DECEMBER 8,2009

PRESENT: Russell Thomas, Chair; Merita Callaway, Vice-Chair; Gary Tofanelli, Steve Wilensky; and Thomas Tryon, Supervisors; James Jones, County Counsel; Jeanne Boyce, Interim County Administrative Officer; and Carol Gates, Supervising Board Clerk

CONSENT AGENDA
1. MINUTES of a regular Board of Supervisors meeting held on November 24, 2009, Board action: approved 5-0
2. CORRESPONDENCE: November 20-25, 2009 – Board action: approved, as processed, 5-0
3. RESOLUTION authorizing amendment #1 to the Joint Powers Agreement between Calaveras County and the Jenny Lind Veterans Memorial District regarding the use of the Gazebo at Jenny Lind Park, Valley Springs, CA; Supervisor Tofanelli – Board action: approved, as amended, 5-0
4. RESOLUTION authorizing amendment #2 to the Joint Powers Agreement between Calaveras County and the Jenny Lind Veterans Memorial District regarding the development and use of the proposed soccer field at Jenny Lind Park, Valley Springs, CA; Supervisor Tofanelli – Board action: approved, as amended, 5-0
5. MINUTE ORDER appointing applicants to serve on the Mental Health Board and the Emergency Medical Services Oversight Committee; County Clerk – Board action: appointed applicant Gary Kuntz to the Mental Health Board for a term to December 31, 1010; and applicant Sergeant Dave Seawell to the Emergency Medical Services Oversight Committee, for a term to 6/30/2012; approved 5-0
REGULAR AGENDA
6. PUBLIC COMMENTS: Lyn Norfolk, Treasurer/Tax Collector provided a public service announcement. Property taxes, for the year 2009, are due no later than 5:00 p.m., on Thursday, December 10, 2009
7. PUBLIC HEARING and possible Board action re: 2009-036 Zoning Amendment for David and Sheila Howard. The applicants have requested approval of a zoning amendment to change the zoning of the subject parcel from CP (Professional Office) to C2 (General commercial). The subject parcel is located at 564 Mt. Ranch Road, on the corner of Mt. Ranch Road and State Hwy. 49 in San Andreas. APN: 42-033-014 is a portion of Section 20 in T4N, R12E, M.D.M.; Planning – Board action: approved 5-0
8. PUBLIC HEARING and possible Board action re: 2006-069 Zoning Amendment for Richard Reynolds. The applicant is requesting a zoning amendment to change the zoning from U (Unclassified) to RR (Rural Residential) for APN: 036-008-143, a 7.01+ acre parcel, and a 17.10 + acre portion of APN: 036-008-142, a 66.38+ acre parcel. The balance (49.28+ acres) of APN: 036-008-142 is already zoned RR. The rezoning of the parcels is a condition of approval for Boundary Line Adjustment #06-39 (Attachment #1). The site location is 9040 Mountain Ranch Road; Planning – Board action: continued for 1 week, to the meeting of December 15, 2009.
9. Discussion and possible action re: MINUTE ORDER approving the cancellation of the Board of Supervisors meeting of December 22, 2009; Administration – Board action: approved, 5-0
10. Discussion and possible action re: RESOLUTIONS (2) appointing directors to special districts; County Clerk/Elections Division – Board action: approved the appointment of applicants Sara Ringlein, Kyle Krause (Veteran), and Barry Griffin (Veteran) to the Mokelumne Hill Veterans Memorial District; and applicant Don Cuneo to the San Andreas Veterans Memorial District; 5-0
11. Review of correspondence, reports and various matters of concern
Supervisor Tryon had nothing to bring before the Board at this time.
Supervisor Wilensky, on Wednesday, will attend a meeting in Sacramento, with the US Forest Service, followed by a 1:30 p.m. meeting with Congressman Dan Lungren, at his Roseville Office, regarding the Rail Road Flat Elementary School; on Friday, in Sacramento, will meet with the Director of Indian Forestry; Monday, in Mokelumne Hill, will meet with the Stewardship Council/PG&E land dispersal group, followed by a 2:30 p.m. meeting with Senator Cox, in his office at the State Capitol, regarding the Rail Road Flat School situation.
Supervisor Tofanelli will attend a Mountain Valley Emergency Medical Services Agency meeting tomorrow at 10:00 a.m. at the Copperopolis Fire Station for a review and discussion of ambulance agreements – the agreements will be coming up for renewal on June 30, 2010.
Supervisor Callaway, on Wednesday, will attend the Visitor’s Bureau open house; Thursday, the Alpine Board of Supervisors meeting in Bear Valley; Monday morning at 11:00 a.m., will meet with Senator Cox, along with Tim Folendorf and Jack Lynch re: the Altaville Park; announced that stimulus dollars have been received by Common Ground, the meal provider for Calaveras and Amador for congregate meals – Catholic Charities received a grant, to be administered by Area 12 Agency on Aging, for services for Calaveras County and Tuolumne County.
Supervisor Thomas will attend the Visitor’s Bureau event on Wednesday; Thursday, the Chamber Mixer at Copper Town Square and the Calaveras Wine Alliance annual Xmas celebration at Kautz Ironstone; Saturday, a Valley Springs Business Association function.
Thomas announced that the Bureau of Reclamation has essentially dismissed the possibility of putting in a road to the west side of Melones - this is a route that was discussed and approved by the Copperopolis Community Plan Advisory Committee prior to submitting the plan to the Board. Thomas requested that a resolution be agendized, for next week, re-inforcing in a stronger form, an earlier Board position.
Thomas reminded the Board of topics for follow-up in 2010 including: the nuisance/noise ordinance, the dark sky ordinance, and the legal access issue.
12. CLOSED SESSION: pursuant to Government Code section 54956.9(b)(1), conference with legal counsel; anticipated litigation – significant exposure to litigation (two cases); County Counsel – Board action: In one case there was no action taken. In the second case, the Board unanimously, with Supervisor Tryon absent, directed staff to prepare the appropriate pleadings to initiate litigation related to Alpine County Board of Supervisors’ final action on the proposed Bear Valley Village development project pending further negotiations regarding transportation impacts mitigation with the developer.
13. Study session/discussion with the County Administrative Officer (CAO) and the Parks & Recreation Commission concerning the allocation of Proposition 40 Funds for administrative fees and the process for funding local park providers; Supervisor Callaway - this was an informational item only
