SUMMARY OF THE MINUTES OF A REGULAR MEETING OF THE BOARD OF SUPERVISORS
COUNTY OF CALAVERAS, STATE OF CALIFORNIA
HELD ON NOVEMBER 24, 2009

PRESENT: Russ Thomas, Chair; Merita Callaway, Vice-Chair; Gary Tofanelli, Steve Wilensky and Thomas Tryon, Supervisors; Jeanne Boyce, Interim County Administrative Officer; James Jones, County Counsel; and Carol Gates, Supervising Board Clerk

CONSENT AGENDA
1. MINUTES of a regular Board of Supervisors meeting held on November 3, 2009 – Board action: approved 5-0
2. CORRESPONDENCE: October 29 thru November 10, 2009 – Board action: approved, as processed, 5-0
3. MINUTE ORDER appointing an applicant to complete an unexpired term to 12/31/10 on the Fish and Game Commission, District III representative; and an applicant to serve as a District IV representative, to complete an unexpired term to 12/31/2010, on the Library Commission; - Board action: appointed Nicholas W. Self to the Fish and Game Commission and Connie Bowser to the County Library Commission; 5-0
4. MINUTE ORDER authorizing approval of project plans, specification, and agreement documents for the construction of multiple bus stop improvements in Calaveras County; Public Works – Board action: approved 5-0
5. RESOLUTION and Traffic Order No. 306 establishing traffic control devices along Mountain Ranch Road; Public Works – Board action: approved 5-0
6. RESOLUTIONS (4) appointing directors to special districts; County Clerk, Elections Division – Board action: 1) appointed Rich Kotowski as a Director of the Appaloosa Road Community Service District for a term ending December 6, 2013; 2) appointed Donald P. Overacker and William W. Schmiett as Directors of the Central Calaveras Fire & Rescue Protection District with terms ending December 6, 2013; 3) appointed Lawrence Robertson as a Director of the Mokelumne Hill Fire District for a term ending December 6, 2013; and Robert C. Pyneneburg and Samuel Chastain as Directors for the Mokelumne Hill Sanitary District with terms ending December 6, 2013; approved 5-0
7. MINUTE ORDER accepting scholarship assistance to allow the Library to participate in the 2010 Get Involved: Powered by Your Library Institute in Irvine, CA on February 23 and 24, 2010; County Library – Board action: approved 5-0

8. RESOLUTION appointing and establishing compensation of County Administrative Officer; Human Resources – Board action: approved 5-0
REGULAR AGENDA
9. PUBLIC COMMENTS: Jean McComber, member of the Humane Society’s new shelter project, gave updated statistics of animals killed at the shelter over the past year. She referred to a lack of progress made to the shelter since 1978. McComber spoke of looking for a more humane method of destroying the animals. She referred to Board approved projects for the shelter. Ms. McComber spoke of the Humane Society giving the County an incredible opportunity to make great strides into the 21st century in giving animals a fair chance to their right to life.
Karen Elliott, a member of Humane Society’s shelter project, introduced Blair Wiley, president of the Society. She referred to a November 10, 2009 letter of agreement, in concept. They are now inquiring as to the status of a resolution. This will be scheduled for the December 15, 2009 Board meeting. Approval of the resolution will enable the society to commence with their fund raising projects.
David Studley, Mountain Ranch, and a member of the Calaveras County Historical Society Board, spoke of expanding the Red Barn Museum in order to preserve the heritage of the County for future generations to come. He expressed gratification and thanks to the Board for their participation with the Society in giving this to the residents of Calaveras County.
Dwayne White, a Historical Society Board member, informed of the progress of the Red Barn extension. The bid for the work was awarded to a local contractor, the High Country Builders from Mountain Ranch. The building should be completed in the early part of 2010.
Bonnie Newman, Double Springs, spoke on two topics: 1) the need for Calaveras County to have orthopedic doctors that will accept medi-cal patients and 2) the need for specialized mental health care assistance for patients, with unusual conditions where the brain is damaged, cannot be repaired, and where there is no way for recovery. The code is written in a way where said patients do not fall under guidelines to receive certain mental health services.
10. Discussion and possible action re: MINUTE ORDER upholding the findings and recommendations of the Administrative Hearing Board in Code Compliance Case #09-12 regarding Claude Guasch Trustee; Code Compliance – Board action: approved, as submitted, 5-0
11. Discussion and possible action re: MINUTE ORDER upholding the findings and recommendations of the Administrative Hearing Board in Code Compliance Case #09-16 regarding Eula Kolb ETAL; Code Compliance – Board action: approved, as submitted, 5-0

12. Discussion and possible action re: approving and prioritizing the FY 2010/11 overall work program project submittals; Public Works – Board action: approved, as amended, to include the Michelson School, Murphy’s Pedestrian Facility; approved 5-0
13. Discussion and possible action re: RESOLUTION approving the purchase of the RIMS/CAD Software and Coplogic Online Reporting System Software for the Calaveras County Sheriff’s Office; (cont’d from 11/03/2009) Sheriff – Board action: approved 5-0
14. Discussion and possible action re: RESOLUTION authorizing the award to construct a Microwave/Mobile Data Terminal (MDT) System for the Calaveras County Sheriff’s Office to Delta Wireless & Surveillance Solutions, along with a BUDGET TRANSFER in conjunction therewith; (cont’d from 11/03/2009) Sheriff – Board action: approved 5-0
15. Discussion and possible action re: RESOLUTION authorizing the Chief Information Officer to enter into a three-year agreement with ESRI for expanded use of GIS software; (cont’d from 11/03/2009) Technology Services – Board action: approved 5-0
16. Discussion and possible action re: RESOLUTION authorizing a contract with Dell Software & Peripherals, in the amount of $81,459.78, for renewal of the Enterprise Software Agreement for the use of Certain Microsoft Products from December 31, 2009 through December 31, 2013; Technology Services – Board action: approved 5-0
17. Review of correspondence, reports and various matters of concern. Supervisor Callaway referenced her attendance at an Ebbetts Pass National Scenic By-Way meeting last night; Monday, along with Supervisor Wilensky and Terry Woodrow, Alpine County Supervisor, will be meeting, via phone conference, with the Forest Service re: the off road vehicle program. Callaway reported on her attendance last week, along with Chair Thomas, at the CSAC conference in Monterey; the State Controller announced that there is a likelihood that at the end of this budget year, the State may be 35 billion in the red; Callaway recommended that our CAO start planning now for strategies on how we are going to handle the budget and how this will impact cities and counties.
Interim CAO Boyce emphasized that we need to be prepared for continued uncertainties.
Callaway referred to discussions at the conference regarding a possible constitutional convention, including 4 proposals, and how the proposals will be worded on the ballot; and a session regarding ABA 11, green building, the retrofitting of homes and businesses for energy conservation.
Supervisor Tofanelli had nothing to bring before the Board at this time.
Supervisor Wilensky, on Monday, will participate in the discussion with the Forest Service re: off-road vehicles; on December 2nd and 3rd will be in Kernville for a Sierra Nevada Conservancy Board meeting; will not be able to attend the December 2nd FEMA flood meeting at Calaveras High School (Supervisors Tofanelli and Thomas will attend); stated that yesterday’s testimony, before the National Resources Sub-Committee, regarding mining went well(will copy the Board with his written testimony); asked for consideration in finding a way to continue funding the Senior Center with a traditional $6,000 contribution; voiced concern of the proposed closing of the Rail Road Flat Elementary School.
Supervisor Tryon had nothing to bring before the Board.
Chair Thomas acknowledged that he had a productive time at the last week’s CSAC Conference; announced that Tony Olivera is the new CSAC president; reminded everyone of the December 2, 2009 meeting at Calaveras High School regarding changes to FEMA flood maps for Calaveras County; announced that the Recreation Management Plan, as developed by the Bureau of Reclamation for New Melones Reservoir, will be presented at the Visitor’s Facility, on December 2, 2009, from 9:00 a.m. to 1:00 p.m.
CAO Boyce thanked the Board for giving her the opportunity to join the Board, and staff, in serving the County. Boyce wished everyone a very happy Thanksgiving.
Counsel Jones had nothing to report at this time.
18. ClOSED SESSION: pursuant to Government Code section 54956.9(b)(1); conference with legal counsel; anticipated litigation – significant exposure to litigation (one case); County Counsel – Board action: no action taken
