SUMMARY OF THE MINUTES OF A REGULAR MEETING OF THE BOARD OF SUPERVISORS
COUNTY OF CALAVERAS, STATE OF CALIFORNIA
HELD ON NOVEMBER 3, 2009

PRESENT: Russ Thomas, Chair; Merita Callaway, Vice-Chair; Steve Wilensky and Thomas Tryon, Supervisors; James Jones, County Counsel; Robert Lawton, County Administrative Officer; and Carol Gates, Supervising Board Clerk

ABSENT: Gary Tofanelli/District I Supervisor

CONSENT AGENDA
1. MINUTES of a regular Board of Supervisors meeting held on October 20, 2009 – Board action: approved 4-0; Absent: Tofanelli
2. CORRESPONDENCE: October 16 – 22, 2009 – Board action: approved as processed; 4-0, Absent: Tofanelli
3. MINUTE ORDER authorizing the County Auditor/Controller to release by warrant the Presley Funds to the Resource Connection Intervention and Prevention Services; CalWorks – Board action: approved 4-0, Absent: Tofanelli
4. RESOLUTION authorizing the purchase of two Type III Transit Vehicles through the California Department of Transportation State Vehicle Contract and a prepayment deposit of 11.47% or $13,764 in an escrow account; Public Works – Board action: approved, as amended, 4-0; Absent: Tofanelli

5. PUBLIC COMMENTS: Paulie Sender, Mountain Ranch, CA referred to a large number of phone calls and approaches regarding the speed limit in the town site of Mountain Ranch. She asked Public Works to take action in lowering the speed limit as soon as possible. Ms. Sender, in referring to State and Federal regulations, emphasized that we need to remember that we are a small town community and need to consider the people.

Supervisor Wilensky spoke of applying a consistent approach in entering our towns and slowing traffic down to a safe level.

Rosemary Wilson, Mokelumne Hill, CA and a property owner on Mountain Ranch Road voiced strong concern of the posted 55 mile per hour speed limit.
Bob Dean, CCWD, spoke in support of Ms. Sender’s safety concerns within the Mountain Ranch town site.

11/03/2009 SUMMARY
Tom Garcia, Public Works Director, verified that staff has completed a radar speed survey of the area. Preliminary indications are that adjustments will be made. Garcia spoke of calling a public meeting with Mountain Ranch residents to inform them of what is being done and to let them know that the speed limit will be lowered.

Paul Stein, West Point, spoke of taking a position on the Calaveras Community Foundation. He referred to creating a giving option for the Foundation – the Galen Stein Dream-Catchers Fund – established in memory of his son, Galen who passed away in 1990 at the age of 15. Contributions will help fulfill the dreams of special needs individuals.

Bob Dean, CCWD, referred to the Board signing a resolution in support of the New Hogan Project and asking a Board member to accompany CCWD representatives on a trip to Washington DC. The purpose of the trip was to meet with legislative representatives to request funding for serious infrastructure water needs within the County. As an overview, he stated the trip was very successful as they received a lot of positive response.

Ed Pattison, CCWD/Water Resource Manager, gave a rundown of offices visited while in Washington DC. He felt the trip was critical in introducing projects that are necessary to be pro-active to manage our infrastructure and resources in a way that is regionally self sufficient and sustainable. Pattison spoke of positive results, in this initial effort, with the joint travel of CCWD and the County.

Supervisor Wilensky emphasized the fact that showing up does matter. He indicated that the CHIPS project would have never received the $500,000 award if was not for his trip to Washington DC and meeting with key people.

Lorey Weatherby, Mokelumne Hill, CA addressed the Board regarding concerns of drastic cuts in home health care services. She referred to her mothers past dedication as a County employee and now being home bound and unable to speak out for herself. She referred to the complex, chaotic situation we are in regarding home health care. Ms. Weatherby stated that she has set up a committee and every Thursday and Friday morning she has volunteered to work at the Senior Center to assist our seniors and disabled population in getting the services they are entitled to and need.

Captain Ballard, Sheriff’s Department, and Art Lytle, Project Manager, submitted the November 2009, Issue 9, Adult Detention Facility project report as prepared by Kitchell. Captain Ballard announced that at the November 24, 2009 Board of Supervisors meeting they have scheduled a presentation of the project. The presentation will include 30% design, staffing and operations along with mitigation requirements.

Mike Kriletech, Chief Probation Officer, submitted pictures of the Supervisors that were done by Jane Carter of Calworks as a part of the 2009 Halloween/Stone Soup celebration. He announced that Behavioral Health, once again, won the Stone Soup award. Kriletich further announced that County employees collected 4,188 pounds of food and $1100 to be donated the local food bank.

Supervisor Wilensky stated that the Behavioral Health Jobs Club claims the most pounds donated. Wilensky referred to a letter he received from Kriletech informing of his plan to retire. He referred to Kriletech as changing the work culture of the department and making a positive difference in the lives of many people.

6. Discussion and possible action re: RESOLUTION approving the purchase of the RIMS/CAD Software and Coplogic Online Reporting System Software for the Calaveras County Sheriff’s Office; Sheriff – Board action: continued to November 24, 2009

7. Discussion and possible action re: RESOLUTION authorizing the award to construct a Microwave/Mobile Data Terminal (MDT) System for the Calaveras County Sheriff’s Office to Delta Wireless & Surveillance Solutions; Sheriff – Board action: continued to November 24, 2009

8. Discussion and possible action re: RESOLUTION authorizing the Chief Information Officer to enter into a three-year agreement with ESRI for expanded use of GIS software; Technology Services – Board action: continued to November 24, 2009

9. Discussion and possible action re: RESOLUTION re: California Product Stewardship Council and consideration of extended producer responsibility framework approach; Public Works (cont’d) item from 09/20/2009) – Board action: continued to November 10, 2009

10. Review and discussion regarding the final draft housing element prior to submittal to the Department of Housing and Community Development; Planning – Board action: motion made to forward the document to the State and to thank and acknowledge those individuals responsible for producing the document; approved 3-1-1 with Supervisor Tryon voting in the negative and Supervisor Tofanelli absent.

11. Review of correspondence, reports and various matters of concern. Supervisor Tryon will attend a meeting of the Council of Governments (COG) on Wednesday.
Supervisor Wilensky will attend a Behavioral Health Board meeting this afternoon; Wednesday a meeting with a delegation from Hayfork on forest issues through the National Forest Foundation; Thursday, the Mountain Oaks Service Learning event; Friday morning, a 1st Five Board Commission meeting followed that afternoon by a conference at Chico State regarding economic conversion and jobs; Saturday will be a speaker at the State Conference of Planning Commissioners; Monday, the Sierra Nevada Conservancy meeting in Auburn, followed that evening by a Paloma Community Club meeting.

Supervisor Callaway spoke of the Fish & Game Commission asking if the Board wants the same appointees going into the next year; tomorrow morning will attend an Ebbetts Pass Property Owner’s Council meeting; Wednesday, COG; Thursday, an Area 12 Agency on Aging meeting; a Habitat for Humanity open house, followed by the Mountain Oaks event.

Chair Thomas acknowledged the accomplishments of the Poultry Judging Team of Bret Harte High School.

Supervisor Callaway proposed that this year’s Jim Moffett award be given to the County Library.

Counsel Jones and CAO Lawton had nothing to bring before the Board at this time.
