SUMMARY OF THE MINUTES OF A REGULAR MEETING OF THE BOARD OF SUPERVISORS
COUNTY OF CALAVERAS, STATE OF CALIFORNIA
HELD ON SEPTEMBER 22, 2009

PRESENT: Russ Thomas, Chair; Merita Callaway, Vice-Chair; Gary Tofanelli, Steve Wilensky and Thomas Tryon, Supervisors; James Jones, County Counsel; and Carol Gates, Supervising Board Clerk

CONSENT AGENDA
1. MINUTES of a regular Board of Supervisors meeting held on September 8,
2009 – Board action: approved 5-0
2. CORRESPONDENCE: September 4-10, 2009 (see attached) – Board action: approved, as processed, 5-0
3. RESOLUTION authorizing the extension of a subdivision improvement agreement for Copper Hills Unit 1, Tract 93-535; Public Works – Board action: approved 5-0
4. RESOLUTION establishing tax rates for Voter-Approved Bond and Interest Debt Requirement for Fiscal Year 2009-10; Auditor-Controller – Board action: approved 5-0
5. RESOLUTION declaring October 5, 2009 as Calaveras Habitat Day – Board action: approved 5-0
R E G U L A R A G E N D A
6. PUBLIC COMMENTS: Michael Krilitech, Chief Probation Officer, spoke of this year’s Halloween festivities as an event for bringing people together. He referred to last year’s Stone Soup Award and collecting approximately 6,000 pounds of food the County Food Bank. The Stone Soup Award will also be a part of this year’s celebration.
Krilitech spoke of allotting 2 Saturdays per month for Government Center landscape maintenance. This is done by juveniles that have been ordered to do community service, in lieu of detention.
Darryl Rusk, Burson, CA, regarding Trinitas, spoke of letting go and looking back on past ideas and decisions. Rusk stated that perhaps now is the time to make some adjustments to our thinking.
Jim Turley, SEIU Representative, spoke of a 4.9 increase in employee health insurance. He felt the topic should have been a closed session item on today’s agenda. He asked the County to absorb the increase. Turley referred to the employees as very important County assets.
Bonnie Newman, Double Springs, questioned when it would be an appropriate time to ask what is happening in negotiations. She referred to employee access to health care. Newman made reference to health care providers that have no health care benefits.
09/22/2009 SUMMARY
Joe Kelly read into the record a September 3, 2009 letter regarding Government Code sections relative to public comment, appointment of applicants to the Board of Equalization, requesting that the conduct of business be modified to include a statement of public comment assigned to each agenda item.
Al Segalla, Calaveras Taxpayer’s Association, had a procedural suggestion regarding Board correspondence. He suggested publishing the actual correspondence item on the County website.
Supervisor Callaway explained that the Board is not taking action on the item. They are only taking action that the Board received the correspondence. She reminded that copies of all Board correspondence are in the County Clerk/Board of Supervisors Office and available to the public.
7. Discussion and possible action re: the introduction of an Ordinance to establish eligibility and continuing education requirements for the position of County Treasurer-Tax collector – Board action: continued to the meeting of October 6, 2009
8. Discussion and possible action re: RESOLUTION authorizing award of an Household Hazardous Waste (HHW) collection services; Public Works – Board action: approved, as submitted, 5-0
9. Discussion and possible action re: RESOLUTION to suspend wood and yard waste fee and adjustment of Integrated Waste Budget and Services; Public Works – Board action: none
10. Discussion and possible action re: Board of Supervisors response to the 2008-2009 final Grand Jury Report; County Counsel – Board action: continued to the meeting of October 6, 2009; 5-0
11. Discussion and possible action appointing Board of Equalization (BOE) members from pool of public applicants and Board of Supervisor (BOS) members, under R & T Code 1622.1 and 1622.2; - Board action: approved the appointments of S. Guy Puccio, Anita Paque, Larry D. Hart, Karen Rubio and Jorge A. Cantreras; 5-0
The order of appointment, for the duration/staggering of terms as follows: 1) S. Guy Puccio; 2) Anita Paque; 3)Jorge A. Cantreras; 4) Larry D. Hart; and 5) Karen Rubio; approved 5-0
12. Review of correspondence, reports and various matters of concern. Supervisor Tryon referred to an item of correspondence from the Fair Grounds asking for the waiver of a late fee in conjunction with their payment of a County Solid Waste fee.
CAO Lawton informed of discussing the issue with the Treasurer-Tax Collector. He stated that the County does not have the latitude to waive the penalty.
09/22/2009 SUMMARY

Tryon will attend the annual RCRC conference on Thursday and Friday.
Supervisor Thomas asked Administration to send letters of appreciation for applications received from Carol Ann McDaniel, Joseph C. Kelly and Maureen L. Elliott requesting appointment to the Board of Equalization
Joseph Kelly referenced a statement made at the September 1, 2009 Board of Supervisors meeting, that he has a legal action against the County and this would be a conflict of interest, if appointed to the Board of Equalization. Kelly referred to this as retaliatory discrimination.
Supervisor Tryon clarified that his selection of candidates to the Board of Equalization had nothing to due with Mr. Kelly’s lawsuit.
Supervisor Wilensky will attend the Joint RCRC and Sierra Nevada Conservancy meeting on Wednesday and Thursday; Friday will meet with Senator Cox for a visit of District II to take a look at forest conditions and remedies being proposed on fire; Sunday, will attend a hazardous waste event in West Point; referred to correspondence regarding the Sierra Nevada Conservancy restarting 142 projects. Wilensky spoke of 3 of the projects as unique to Calaveras County.
Supervisor Tofanelli will participate in a teleconference tomorrow with the Corp of Engineers regarding Cosgrove Creek; Thursday, the Chamber Mixer at LaContenta; Friday, a luncheon at Greenhorn with Senator Cox; and Saturday the Burson/Wallace school dedication.
Supervisor Callaway will attend an Ebbetts Pass Board Council meeting this week; a Fish & Game Commission meeting; a Juvenile Justice meeting; the Health Fair at Mark Twain St. Joseph’s Hospital; and a retirement celebration for Patrick Stevens.
Chair Thomas will participate in the teleconference with the Corp of Engineers regarding Cosgrove Creek; announced that deer season opens this weekend.
Counsel Jones and CAO Lawton had nothing to bring before the Board at this time.
13. CLOSED SESSION: pursuant to Government Code section 54956.9: conference with legal counsel re: existing litigation – (two cases); Michael Nemee and Michelle Nemee v. County of Calaveras, Calaveras Superior Court Case No. CV35775; Michael Nemee and Michelle Nemee v. County of Calaveras, Calaveras Superior Court Case No. CV35721 – County Counsel – Board action: nothing to report
14. CLOSED SESSION: pursuant to Government Code section 54957 – Public Employee Performance Evaluation – County Administrative Officer (cont’d from 09/08/09 and 09/15/09) Board action: nothing to report
