COUNTY OF CALAVERAS, STATE OF CALIFORNIA
HELD ON JUNE 2, 2009

1. MINUTES of a regular Board of Supervisors meeting held on May 19, 2009 - Board action: approved 5-0
2. CORRESPONDENCE: May 15-22, 2009 - Board action: approved, as processed
3. RESOLUTION designating Ebbetts Pass Fire District Station One as a Safe Surrender Site; Ebbetts Pass Fire District - Board action: approved 5-0
4. Discussion and possible action re: RESOLUTION amending the fees for zoning amendments, continue the practice of charging 100% of the application fee for the most expensive application, and 50% for all other applications submitted at the same time for the same property, and maintain a zero application fee for administrative use permits for historic events and $100 for community based or non profit events regardless of county department costs; Planning - Board action: approved 5-0
5. MINUTE ORDER authorizing the Planning Department to issue a refund of $26,728.07 to applicants Michael and Michelle Nemee for unused contract funds for project 2004-114, ZA, TSTM, The Ridge at Trinitas; Planning - Board action: approved 5-0
6. RESOLUTION declaring the month of June 2009 as "Hunger Awareness Month"; Administration - Board action: approved 5-0
7. RESOLUTION authorizing the Director of Calaveras Works and Human Services Agency to enter into and execute, on behalf of the County of Calaveras, agreements with the California Department of Social Services, for reimbursement of interim assistance payments made pursuant to public law 93-368, effective July 1, 2008 through June 30, 2013 and further authorize the Director to execute documents as required by these agreements; CalWORKs - Board action: approved 5-0
8. RESOLUTION approving the application for a Farm and Ranch Solid Waste Cleanup and Abatement Grant for the Mitchell Mill Disposal Site; Environmental Management Agency - Board action: approved 5-0
9. RESOLUTION authorizing submittal of Local Enforcement Agency Grant applications to the California Integrated Waste Management Board; Environmental Health Agency - Board action: approved 5-0

12. MINUTE ORDER authorizing the distribution of $1750 from District 5 Board Project Fund: $500 to Copperopolis Community Center; $500 to Copperopolis Parks and Recreation Committee; and $750 to Valley Springs Boosters; Supervisor Thomas - Board action: approved 4-1; NOES: Callaway
13. RESOLUTION accepting the canvass of the Ebbetts Pass Fire Protection District Special Election held on May 5, 2009; County Clerk/Elections - Board action: approved 5-0
REGULAR AGENDA
14. PUBLIC COMMENTS: Chair Thomas recognized the presence of and introduced George White, the County’s newly appointed Planning Director; and Tom Garcia, the County’s newly appointed Public Works Director.
Frank Ginger expressed concern of public buses blocking handicap loading zones. He stated that this is a violation of the law.
Ingrid Brown, Wallace, CA spoke of the County not having a noise ordinance. She referred to an individual driving his ATV’s with modified mufflers and having no respect or consideration of neighbors.
Clyde Clapp, Burson, CA emphasized the need for ordinance reinforcement.
Terry Baker, Rail Road Flat, Ca submitted a CD of his court trial; referred to addressing the Board on November 27, 2008 regarding a noise issue with his neighbors, the Redmond’s. He referred to Ordinance 2905 – Project 2006-74 ZA Blue Mountain Residential Center Conformance Rezoning. Mr. Baker stated that the parcel in question has never been rezoned RA.
Supervisor Wilensky responded to Mr. Baker regarding a contradiction between the zoning and letters from the Planning Department. Wilensky stated that the original ordinance referenced a map that was inclusive of Mr. Baker’s area. The listing at the top of the ordinance contained a typo that did not specifically include the section in question. This is the source of the confusion. Wilensky stated that he has asked the Department to reconcile the issue and report back to the Board.
Marti Crane, Director of the Calaveras Volunteer Center, spoke of volunteers stepping up to the plate when times are hard. She stated that she is encouraged about society in general. Ms. Crane referred to Kid’s Day as an all inclusive wonderful day. She thanked those organizations that were instrumental in making it happen.
Jeanne Hayward, Program Director of the Resource Connection Food Bank, thanked the Board for declaring June as Hunger Awareness Month. She spoke of having the facility and capacity to serve safety net foods to the community.
William Moore, Valley Springs, CA addressed the Board regarding a proposal to lodge Guantanamo Bay prisoners in Calaveras County. He stated that there are patriotic political reasons and definite financial reasons why

we should consider the proposal. He felt the idea could generate income for county administration. He felt that the initial reaction to the proposal will be, Not-in-My-Back-Yard (NIMBY). Moore referred to the idea as a sincere proposal, worthy of serious consideration.
Bonnie Newman, a Calaveras County Health Care Worker, voiced frustration regarding a cut in salaries/wages for said workers. She stated the Public Authority proposed the wage reduction without previous notification to those involved. She stated the Health Care Workers had no idea that this was coming. Newman felt the action was pre-mature and asked that the action be rescinded.
Tim McSorley/Director, Council of Governments (COG), announced that July 22, 2009 is the opening date for the Angels Camp by-pass. McSorley stated that construction is now 1 ½ years ahead of schedule.
Ed Ballard, Sheriff’s Department, submitted the June 2009, Issue 4 status report, regarding the Calaveras County Adult Detention Facility.
15. Discussion of findings and possible action re: approval of a RESOLUTION authorizing a boundary line adjustment for land restricted by a California Land Conservation Contract; Dept. of Agriculture - Board action: approved 5-0
16. A presentation was given by Jamie Azarvand, Public Works/Transportation Planner, regarding the Calaveras Transit Short Range Transit Plan update draft plan.
17. PUBLIC HEARING and possible Board action re: Fiscal Year 2009/10 Calaveras Transit Service Changes; Public Works - Board actions: unanimously approved a minute order revising fare structure; unanimously approved a minute order eliminating provision of charter services; motion made to approved scenario B, as submitted by staff, approved 4-1; NOES: Tryon
18. Discussion and possible action re: approval and execution of a 1-year and 0-month lease agreement between the County and the Murphys Creek Theater Conservatory (MCTC) group for the Black Bart Playhouse in Murphys; Administration (cont'd item from 05-26-09) - Board action: approved 5-0
19. Discussion and possible action re: RESOLUTION authorizing Board Chair to sign a 1 year lease with ABBA FLP for space at 90 Copper Cove Drive, Suite D, in the amount of $1600 per month, commencing on July 1, 2009 with actual occupancy to begin on June 22, 2009; County Library (cont'd item from 05/26/2009) - Board action: approved 5-0
20. Review of correspondence, reports and various matters of concern. Supervisor Tryon will attend a Council of Governments (COG) meeting Wednesday evening.

6/2/2009 SUMMARY

Supervisor Wilensky will not be able to attend this afternoon’s Mental Health Advisory meeting due a meeting with the Delta Community College Board to discuss possible services and facilities in Calaveras County;
Supervisor Callaway will attend the Mental Health meeting on his behalf; Wednesday will meet with CUSD; will attend a West Point Scholarship Fund meeting; Friday a Blue Mountain Renewal Council meeting; a 1st Five Board meeting; and Monday, a Paloma Community meeting.
Supervisor Tofanelli will attend the Delta College Board meeting this afternoon at 4:00 p.m. followed by a 6:00 p.m. Community Plan meeting in Valley Springs.
Supervisor Callaway referred to continuing financial impacts; asked for Board approval in writing a letter, for Chair’s signature, in support of State Parks of the central valley park system, including Calaveras Big Trees, the Ebbetts Pass Scenic Byway, Grover Hot Springs, and the Grinding Rock Park; she stated that you can no longer lobby for a program unless you have a recommendation to save the program or cut something out; will attend an Ebbetts Pass Property Owner’s Council meeting; COG on Wednesday; an Area 12 Agency on Aging meeting on Thursday, followed by a Calaveras Public Power Agency meeting.
Supervisor Thomas referenced tomorrow’s Economic Development Council meeting in Sonora; Friday, will attend a Law Library meeting.
CAO Lawton referred to last week’s CSAC meetings; spoke of the severity of the budget situation; stated that now is a challenging time for all.
Assistant Council Sirias reminded of today’s closed session.
21. CLOSED SESSION: pursuant to Government Code Section 54956.9: conference with legal counsel re: existing litigation; Michael Nemee and Michelle Nemee v. County of Calaveras, et al; Calaveras Superior Court Case No.: CV35721 - County Counsel - Board action: no action taken
