SUMMARY OF THE MINUTES OF A REGULAR MEETING OF THE BOARD OF SUPERVISORS
COUNTY OF CALAVERAS, STATE OF CALIFORNIA
HELD ON FEBRUARY 17, 2009

CONSENT AGENDA

1. MINUTES of a Board of Supervisors meeting held on February 3, 2009 – Board
action: approved, 5-0
2. CORRESPONDENCE: January 30 thru February 5, 2009 – Board action:
approved, as processed, 5-0
3. RESOLUTION authorizing execution of a professional services agreement with
LSC Transportation Consultants, Inc., to update the Copperopolis Benefit Basin
Traffic Analysis: Public Works – Board action: approved 5-0
4. RESOLUTION authorizing execution of a professional services agreement with
LSC Transportation Consultants, Inc., for assistance with update of the General
Plan Circulation Element and EIR; Public Works – Board action: continued to the
meeting of February 24, 2009
REGULAR AGENDA

5. PUBLIC COMMENTS: Jim Bergantz, Angels Camp, referred to the Seeds of Kindness Committee sponsoring “Pass it On Kindness Week” for the week of February 16-22, 2009. Ribbons and brochures were distributed to the Board. Recipients will wear their kindness ribbons and pass them along when kind actions are witnessed. Bergantz challenged the County to jump into the kindness zone.

Michael Miller, Interim Director of Public Works, gave an update of weekend weather related activities. A heavy snow fall was experienced throughout various areas the County. Ninety six calls were reported early Friday with 13 reported tree related calls.

6. Discussion and possible action re: approval of a Memorandum of Understanding (MOU) with the 39th District Agricultural Association for County use of Fairground facilities; Administration – Board action: staff was directed to schedule a joint meeting with the Association prior to budget hearings.

7. Discussion and possible action re: 2003-114 ZONING AMENDMENT AND TENTATIVE SUBDIVISION TRACT MAP (Wallace Lake Estates, Unit 2) for Pinnacle Land
Ventures, LLC (cont’d item from 01/27/09); Community Development Agency/Planning Department – Board action: accepted applicant’s withdrawal of Zoning Amendment

8. Discussion and possible action re: approval of Memorandum of Understanding

10. Review of correspondence, reports and various matters of concern.
Supervisor Tryon had nothing to report.

Supervisor Wilensky will attend a 1st 5 meeting with Children’s Dental Network; a Job Clubs Sub-Committee of the Mental Health Advisory Board; a staff advance strategies training session regarding methamphetamine intervention for criminal justice and treatment providers at Kautz Ironstone on February 23, 2009.

Supervisor Tofanelli will be attending a Chamber meeting; a Valley Springs ABA meeting at the Methodist Church; the VFW Crab Feed and the Friends of the Library Trivia Bee.

Supervisor Callaway will not be in attendance at next week’s Board meeting; asked Supervisor Tryon to attend a Fish & Game meeting as the Board’s alternate representative.

Supervisor Thomas will attend a Valley Springs Business Association meeting; an interview with our local TV channel; and a LAFCO meeting next Monday.

CAO Lawton and Counsel Jones had nothing to report.

11. CLOSED SESSION: pursuant to Government Code section 54956.9(c); conference with legal counsel; anticipated litigation – initiation of litigation; one case; County of Calaveras v. Controller – John Chiang, et al.; County
Counsel – Board action: By a unanimous vote, the Board directed County Counsel to take action to cause Calaveras County to join as a party plaintiff in the case of County of Sacramento v State of California, Sacramento County Superior Court, action number 34-2009-80000 164-CU-WM-GDS.
