Washington, DC...Court Splits the Baby on Immunity & Sends Back to Lower Court. Now the lower court has to make adjustments to potential charges if any after the Supreme Courts ruling on using the Enron Rule. From the opinion..."A federal grand jury indicted former President Donald J. Trump on four counts for conduct that occurred during his Presidency following the November 2020 election. The indictment alleged that after losing that election, Trump conspired to overturn it by spreading knowingly false claims of election fraud to obstruct the collecting, counting, and certifying of the election results. Trump moved to dismiss the indictment based on Presidential immunity, arguing that a President has absolute immunity from criminal prosecution for actions performed within the outer perimeter of his official responsibilities, and that the indictment’s allegations fell within the core of his official duties. The District Court denied Trump’s motion to dismiss, holding that former Presidents do not possess federal criminal immunity for any acts. The D. C. Circuit affirmed. Both the District Court and the D. C. Circuit declined to decide whether the indicted conduct involved official acts.

California Prepares for Dangerous Heatwave Ahead of Fourth of July

Sacramento, CA... With temperatures set to exceed 110 degrees throughout much of the state this week, Governor Gavin Newsom is urging Californians to take extra precautions as they celebrate the Fourth of July. The Governor directed the Office of Emergency Services to activate its State Operations Center and move into Phase II of its Extreme Temperature Response Plan. This is triggered by National Weather Service (NWS) predictions of excessive heat activity and moves the state into action to coordinate an all-hands response by state government.

California Invests More than $2 Billion to Fuel Economic Opportunity, Increase Access & Protect the State’s Vital Transportation Infrastructure

Sacramento, CA...The California Transportation Commission (CTC) today approved more than $2 billion to improve and maintain a transportation system that serves as the backbone for the world’s fifth largest economy. The approved funding will support the next generation of transportation projects, ranging from bridge maintenance and rail system upgrades to enhanced railroad safety features and increased access for bicyclists and pedestrians. These benefits will help power economic opportunity as well as mitigate the effects of climate change.

San Andreas, CA...Calaveras County Public Health is pleased to announce the release of the 2023 Calaveras Community Health Assessment, a comprehensive examination of the health needs and priorities within our community.  The assessment, which started in August 2022, included three phases: key informant interviews, focus group discussions, and a community-wide survey. This thorough investigation explored various aspects of community health, focusing particularly on critical areas such as access and affordability, mental health, health and wellbeing, health behaviors, and substance use. By engaging with key stakeholders, community members, and experts, the assessment aimed to gather diverse perspectives and insights to inform strategic health initiatives and resource allocation.

Calaveras County Announces the Opening of Cooling Centers due to Excessive Heat Warning

San Andreas, CA...The U.S. National Weather Service has issued an excessive heat warning for Calaveras County. The warning remains in effect from 11 AM Tuesday, July 2nd through 8 PM Sunday, July 7th. During this time, temperatures are expected to exceed 105 degrees with limited overnight relief.

S. 837, should be overruled or clarified. Under the Chevron doctrine, courts have sometimes been required to defer to “permissible” agency interpretations of the statutes those agencies administer—even when a reviewing court reads the statute differently.

Washington, DC...US Supreme Court Limits "Enron Rule" or "Obstruct an Official Proceeding" Prosecutions. This ruling could lessen, overturn or eliminate many J-6 felony cases. From the syllabus..."The Sarbanes-Oxley Act of 2002 imposes criminal liability on anyone who corruptly “alters, destroys, mutilates, or conceals a record, document, or other object, or attempts to do so, with the intent to impair the object’s integrity or availability for use in an official proceeding.”18 U. S. C. §1512(c)(1). The next subsection extends that prohibition to anyone who “otherwise obstructs, influences, or impedes any official proceeding, or attempts to do so.” §1512(c)(2). Petitioner Joseph Fischer was charged with violating §1512(c)(2) for his conduct on January 6, 2021.

Governor Newsom Says "California Beats Big Oil – Again"

Sacramento, CA...California notched another victory against Big Oil. The industry announced it is pulling its referendum aimed at repealing California’s law protecting neighborhoods from the dangerous impacts of drilling. The measure that would have appeared on this November’s ballot could have allowed the oil industry to keep drilling new wells within 3,200 feet of homes and schools and operating existing wells without critical pollution controls.

And once again, the Supreme Court has decided in the favor of special interests, just as it did when they sought to gut long-standing protections for clean water, thwart efforts to respond to a global pandemic, and block the cancelation of crippling student debt for tens of millions of Americans.
