Supreme Court Rules Warrants Needed For Cell Phone Searches

Washington, DC....From Opinion in the Riley v California case. "Our cases have recognized that the Fourth Amendment was the founding generation’s response to the reviled“general warrants” and “writs of assistance” of the colonial era, which allowed British officers to rummage through homes in an unrestrained search for evidence of criminal activity. Opposition to such searches was in fact one of thedriving forces behind the Revolution itself. In 1761, the patriot James Otis delivered a speech in Boston denouncing the use of writs of assistance. A young John Adams was there, and he would later write that “[e]very man of acrowded audience appeared to me to go away, as I did,ready to take arms against writs of assistance.” 10 Works of John Adams 247–248 (C. Adams ed. 1856). According to Adams, Otis’s speech was “the first scene of the first act of opposition to the arbitrary claims of Great Britain. Then and there the child Independence was born.” Id., at 248 (quoted in Boyd v. United States, 116 U. S. 616, 625 (1886))...

Arnold Robbery Investigation

Arnold, CA...On 6/20/2014 at 2200 hours, Deputies were dispatched to the 1700 block of Maple Street, in Arnold, to investigate a Robbery. The victim reported that suspects Jimmy Blake Terry of Arnold (27 yrs. old), Phillip Ryan Coulson of Angels Camp (28 yrs old), and an unknown male went to his residence and unexpectantly struck him with unknown item, and he fell to the ground. The victim reported that he was held down by Phillip Coulson, while Jimmy Blake Terry punched him. The unknown male stood back and did not participate in the battery. Phillip Coulson and Jimmy Blake Terry moved the victim against his will and took items from his residence and cash from his wallet. Both Phillip Coulson and Jimmy Blake Terry are currently on PRCS and supervised by Calaveras County Probation Department; Terry was also on ankle monitoring at the time of the incident. With assistance from the Probation Department, the Sheriff’s Department was able to electronically track Jimmy Blake Terry....

Ricky Roberts Homicide Suspect Arrested

Sonora, CA...18 June 2014, a Detective from the Sonora Police Department and a Sergeant from the Tuolumne County Sheriff’s Department contacted Cheryl Lucero, 45 of Twain Harte, who was a person of interest in regards to the Ricky Roberts homicide investigation. Lucero was also an acquaintance of Roberts. During their contact with Lucero, Lucero admitted to her involvement in the Roberts homicide. Following the interview with Lucero, she was arrested without incident and booked into the Tuolumne County Jail for homicide. Bail has been set at one million dollars...

Intermountain Camp Walkaway Inmate in Custody

Susanville, California – A minimum-security inmate from California Correctional Center (CCC) who walked away from a Shasta City Grade Project on June 4, 2014, has been apprehended. On June 6, at approximately 7:30 pm, members of the High Desert State Prison/ California Correctional Center (HDSP/CCC) Crisis Response Team (CRT) apprehended Inmate Lepaul W. Gardner in Carrick California, just north of the community of Weed. An investigation has been initiated to determine if any other crimes have been committed by Inmate Gardner while he was at large.

CDAA's Investigator Of The Year Award Goes To Gary Stevens!! His Exemplary Work On Bergo Case Highlighted!

Sacramento, CA....The California District Attorneys Association (CDAA) has selected the recipients of its 2014 awards, to be presented at the annual CDAA Summer Conference in Newport Beach on June 26, 2014. The 2014 recipients are: The District Attorney Investigator of the Year award recognizes investigators whose outstanding ability and professional dedication merit the respect and recognition of prosecutors. The 2014 recipient is Gary Stevens from the Amador County District Attorney’s Office. A peace officer for 24 years, the last six with the DA’s office, Mr. Stevens spent over two years investigating and gathering evidence in the murder of an elderly woman, whose son, Justin Bergo, was eventually found guilty of the crime. Amador County DA Todd Reibe describes Mr. Stevens’ work on that case as,“one of the best examples of investigative work I have seen in my 23 years practicing criminal law.”

“DA Investigator Chosen for Prestigious Award”

Jackson, CA...Amador County District Attorney Investigator Gary Stevens has been chosen by the California District Attorneys Association to receive its Investigator of the Year award for 2014. Stevens was selected in recognition of his work handling complex investigations for the office highlighted by his outstanding effort as the lead investigator in the Justin Bergo murder case in Sutter Creek. Stevens has been a peace officer for 24 years, the last 7 as a DA Investigator in Amador County. He is assigned to the General Criminal division where he works closely with the Deputy District Attorneys, handling many of the toughest cases in the office. As Amador County is a rural county, Stevens is called upon at times to provide assistance to the city police departments. Seeing a need, he sought and obtained certification as one of the county’s two fingerprint examiners, thus reducing the waiting period for criminal cases to be filed...

Copperopolis Man Found Guilty Of Rape Of A Minor

San Andreas, CA....On June 11, 2014, a Calaveras County jury found Robert Walker, 32, guilty of raping a child under the age of ten with two prison priors. Deputy District Attorney Dana Pfeil prosecuted the case on behalf of the Calaveras County's DA Office. "The victim was very believable and showed incredible courage in testifying. The Jury believed her and I am pleased that justice was served today", Pfeil said....

Sonora, CA... 7 June 2014, at approx. 1:15 pm, emergency personnel responded to the east entrance/exit of the Sonora Plaza for a reported vehicle vs. pedestrian accident. Diana Greener, 54, and Arthur Greener, 69, both of Sonora, were walking northbound on the west sidewalk of Greenley Road, at the east entrance/exit of the Sonora Plaza.
