COUNTY OF CALAVERAS, STATE OF CALIFORNIA
HELD ON OCTOBER 21, 2008

2.RESOLUTION approving Amendments to Conflict of Interest Codes for Calaveras County Water District; Mark Twain Health Care District, Calaveras County Board of Education and Calaveras County Local Agency Formation Commission; County Counsel - Board action: approved 4-0-1; Absent: Wilensky
3.RESOLUTION updating the County Conflict of Interest Code to Incorporate Revisions made to the FPPC Model Code and a RESOLUTION updating the Appendix of Designated Positions to the Conflict of Interest Code; County Counsel - Board action: approved 4-0-1; ABSENT: Wilensky

6.PUBLIC COMMENTS: Franciska Schabram, Gillam Road resident, acknowledged and thanked those instrumental in the repair of Gillam Road, including the Board of Supervisors, the Department of Public Works, Congressman Dan Lungren’s Office; the Foothill Volunteer Fire Department and the local press. She urged the Board to oppose the proposal of Fish & Wildlife to expand the existing critical habitat for the California Red-Legged Frog by 4,000 acres. Mrs. Schabram proudly announced that, a couple weeks ago, she and her husband became US citizens.

Frank Ginger expressed, and submitted pictures, of a continuing concern regarding public transit buses blocking handicap parking areas. He further referred to illegal dumping of toxic waste near West Point.

10/21/2008 SUMMARY

Steve Kafka of the County Farm Bureau and today also speaking on behalf of the Calaveras Cattlemen’s Association, requested that the Board oppose the U.S. Fish and Wildlife Service’s proposal to designate 4,449 acres of land in Calaveras County as critical habitat for the California red-legged frog. The acreage involved represents land holdings in the Young’s Creek area, north of state Highway 26 and south of Paloma Road. He submitted a letter for Board approval that addresses these concern. He further stated the two agencies will be requesting that this subject be agendized for the November 4, 2008 Board of Supervisors meeting.

Nick Hodgson and Nick Baptista, representing the Valley Springs Business Association, presented an overview of the Council’s vision statement for the commercial portion of Valley Springs. Reference was made to the crossroad of two State Highway routes, 12 and 26, as both a blessing and a curse for the community. The vision statement refers to preserving the rural, recreational and historical features that make the area unique and to prepare for orderly growth in the future. Baptista spoke of re-adjusting Highway 12 southward over open land to converge with Highway 26 at Hogan Dam Road. He also spoke of the suggestion of a roundabout at the new Highway 12/26 intersection. Baptista stated that with thoughtful planning now, the County can lay the foundation in creating a community that will function well going into the future while preserving its rural heritage.

Terry Baker, Rail Road Flat, CA spoke of an ongoing rooster – noise and pollution problem regarding David and Carolyn Redmond. He spoke of the Redmond’s taking over a once quiet subdivision. Baker indicated that the Redmond’s were found quilty at a court trial. The second time they went to Court they were found not guilty. Baker referred to the zoning of the property. He questioned the status a County noise ordinance. Vice-Chair Thomas suggested Mr. Baker attend this afternoons study session at which time there will be discussion regarding a noise ordinance.

Lisa Mayo, Calaveras Visitor’s Bureau, gave an update of projects and tourism happenings in Calaveras County. Topics addressed included: the economy, international travelers, partnering with the California Tourism Commission, working towards a 2009 activities guide; support of the bus tour business; attending travel and trade shows; an ongoing weekly press release program; local media involvement; marketing efforts; will travel to Germany in early March to represent the high sierra region at the International Tourism Show; attending group tour meetings and the Go West Summit; discover Calaveras events; currently working on discover Calaveras farm events; networking; presented the Board with “Go-Green” commuter mugs. Ms. Mayo thanked the Board for their continued support of tourism in Calaveras County.

10/21/2008 SUMMARY

Supervisor Callaway referenced an article in this mornings Stockton Record titled “Calaveras County puts millionaires’ cash to good use – this is in reference to the Mental Health Services Act of 2004 – money to be used to expand new services to the mentally ill, especially those that enable them to have greater control over their own lives. The article referred to the millionaires tax as wildly successful in Calaveras County.

8.Discussion and Possible Action Adopting a RESOLUTION Authorizing the Board Chair to Sign a Memorandum of Understanding with The San Andreas Sanitary District to Commence Negotiations Regarding Sanitary Sewer Service to the Calaveras Criminal Justice Center and Adopting a RESOLUTION authorizing the CAO to Sign an Application to The San Andreas Sanitary District; County Counsel - Board action: approved, as modified; 4-0-1; ABSENT: Wilensky
9.PUBLIC HEARING and possible Board action re: RESOLUTION establishing an agricultural preserve and a RESOLUTION entering into a California Land conservation Contract No. 307 for Alan W. Kathan and Steven V. Kathan. The subject property location is bordered by Churchill Road and Pool Station Road; Dept. of Agriculture - Board action: approved 4-0-1; ABSENT: Wilensky
10.PUBLIC HEARING and possible action re: RESOLUTION establishing an agricultural preserve and a RESOLUTION entering into a California Land Conservation Contract No. 299 for Fred Nakagawa, trustee of the Nakagawa Family Trust. 11.Discussion and possible action re: RESOLUTION making findings required by Government Code 66474.4. 12.Review of correspondence, reports and various matter of concern. Supervisor Callaway announced her attendance at a Williamson Act Training Session sponsored by the Department of Conservation; this week will attend a Fish & Game Commission meeting on Wednesday and a Juvenile Justice swearing-in ceremony on Thursday; referred to the Chili Cook-off and Car Show event at the Senior Center on Saturday; announced that Saturday,


10/21/2008 SUMMARY

October 25th is the final trail work day for the Arnold rim trail on forest service land; referenced her attendance last Saturday at Bear Valley for a discussion on the environmental impact report – November 7th is the due date for comments.
Supervisor Claudino will attend a Mountain Valley Medical Services Agency meeting on Wednesday; Thursday, the Historical Society dinner at the Senior Center – a discussion will be held re: the San Andreas Volunteer Fire Department; Friday, a Calaveras/Mariposa Community Action Agency meeting in Coulterville re: the allocation of funds; and Saturday the Chili Cook-Off and Car Show.
Supervisor Tryon, along with Supervisor Callaway, attended a very successful Feeney Park Foundation Bike Ride last Saturday.
Vice-Chair Thomas will auction off Scarecrows at the Copperopolis Town Square on Thursday evening; announced a November 15th Mule Packers Challenge event at the Fair Grounds; this evening will attend a meeting at the Frogtown Cafeteria in an effort to brainstorm ways in which the vitality can be brought to the Fair Grounds; referred to correspondence from CSAC and the selection of a CSAC Board representative for 2009; discussed a Tuolumne County resolution asserting legal standing.
CAO Lawton and Council Jones had nothing to bring before the Board.
13. A study session was held with the Community Development Agency to discuss short term rentals. After discussion the Board directed staff to revise the County Code to provide a definition of short term rental and a general provision section to allow any dwelling unit to be available for short term rental use. After discussion of development standards, no additional standards were added.
