Letter to the Editor Regarding The Trinitas Project~From Mike and Tina Neale
CITIZEN COMMENT ON: The Ridge at Trinitas Project Revised Draft Enivironmental Impact Report....As tax paying residents in the 5th Supervisory District, we wish to express our comments against the rezoning of our precious AP lands, and state why. We ask,...what is this rezoning attempt from AP to REC-X-PD (Recreation-Existing Parcel Size-Planned Development) to accommodate both the subdivision and the recreational uses on the property,...with the Conditional Use Permit (CUP) to regulate the Lodge and other uses requiring a CUP in the REC zoning district all about.....
The County Code states the purpose of the Agriculture Preserve - (AP) - zone is: "to PROTECT and PRESERVE lands for intensive agriculture and ranching production. Agriculture preserve zoning applies to lands for which a Williamson Act contract has been executed. The AP zone may also be utilized for open space protection and preservation. All of the listed permitted and conditional uses allowed in the AP zone are determined by the board of supervisors to be compatible with the definition of agricultural use, recreational or open space use of the land and thus a use authorized in the AP zoning and for lands under a Williamson Act Contract. (Ord. 2859 § 5(part), 2005: Ord. 1807 § 1(part), 1986)."
We've seen pictures of what the Developer wants to build, but not what our County Zoning Code had envisioned for the land's use.
This orchard, pond, and grape vistas are examples of what was envisioned for development on AP lands and why it was so important to designate them as AP in our County's Code and General Plan to emphasize that we must PROTECT and PRESERVE these lands.
If we permit any Developer to rezone any of this precious Calaveras land for uses other than for which it was originally intended, we, and all future generations will NEVER EVER be able to use it for agriculture, open space protection, and preservation as intended. And that would be simply unforgivable.
