Cannabis Logic, Cannabis Black Market & Reasonable Rules ~ Al Segalla

Copperopolis, CA...I attended the recent Board of Supervisor meetings concerning commercial cannabis regulation. It was a hate fest with little good will and logic. Some thoughts: The problems with criminal activity relate to the black market grows, not the permitted ones. This was confirmed by the Sheriff and Ag Commissioner.




The black market is created by government ban just like alcohol prohibition with a similar increase in crime. The black market can also be expanded by over regulation and taxation. Some want regulation to be very extensive. This would have the same effect as a ban. More crime. We do not need more crime. That is why prohibition was repealed.

The key to a better tomorrow, in my opinion, is reasonable rules.

The state already regulates commercial cannabis, but does require a permit from local government. The county already has land use regulations regarding locations, set backs etc. Also, there are existing rules regarding pollution etc. The permit should be easy to obtain at reasonable cost. That is the best way to shrink the black market and crime.

The present proposal has been vetted by government departments involved. Good administration.

Why not get feedback from the industry?

After all, it is the permitted cannabis farmer who will have to abide by the new rules. Make sense?

It didn't help the county released everyone's address last time. Also remember our sheriff went on the news and said he can't protect anyone.

    Pfft, your location will never be hidden. Many maps and aerial views are and will be available to anyone who wants them. Airplane owners and neighbors will post your stinking locations. You are about as naive as it gets. You can't have guns, so you had better hire your own 24 hour security team. We don't have enough law enforcement coverage for the county now, and you will be draining what we do have protecting your drugs.

      The loophole to the guns is to have an LLC (separate legal person) operate the cannabis operation and rent the portion of the parcel that is not the "premise" back to someone with a firearm.

As I understand it, anything greater than six Cannabis plants are considered a "commercial grow". I know of a few folks up here in West Point who grew a little more than their allotted six plants to supplement their income. Let's face it. A lot of us up here are a bit on the poor side. Our Sheriff's Department are real good at finding these folks ...who, as a result, are instantly branded a criminal. It's about time we addressed this situation. As for myself, I'm all for limiting the size of the grow to no more than a few hundred plants.

Al is a nice man, that being said it sucks to be senile. If these drugs are not cheap the black market will flourish just like it is now and has been doing. County governments will go broke with all the massive costs involved to the taxpayers. Much of the product is always syphoned off the books and sold on the black market or used to bribe others.

    Regulated market will never affect the black market, though the black market does affect the regulated market. It makes it to where the regulated market only works for those who can monopolize the regulated industry. This happens easily when you have a ton of cultivators and limited distributors.
    Black market sellers can sell much cheaper due to evading taxation, testing and additional cost related to handling.
