"Unfair Labor Practices Strike" Underway at Columbia College November 27 and Wednesday, November 28

Columbia, CA...What follows is a press release from Yosemite Faculty Assosiation..."YFA writes to correct the misleading and false representations about the state of negotiations and YFA’s anticipated strike in the District’s November 21st statement. With regards to negotiations, the District’s “last, best, and final offer” continues to demand unsustainable class size increases--to 45 students per class. The Union is pushing instead for a pedagogically-driven process with class size determined by faculty and administrators together.




On salary, the District, unlike YFA, has not provided any good faith compromise proposals. Instead, it has only offered to lock faculty into a bad deal for even longer. The District initially offered 6% over three years. Now, after nearly a year of doing nothing, on Wednesday evening it offered 8% over four years. The District seems to think faculty and the public cannot add or divide—and will not realize that it has offered the same bad deal, just over a longer time.

This proposal is regressive. It will keep faculty at the bottom of the cohort of 10 similar college districts negotiated by the District and union. Faculty are an embarrassing 22% below the median of this cohort. It’s clear why, as faculty have received less than 1% on average over the last 10 years.

In the sake of resolving these negotiations, however, faculty have proposed significant compromise offers to the District for far less than the 22% increase required to get to median of the cohort. We also proposed a slower implementation timetable, making it even more desirable for the District.

After receiving the District’s regressive offer from yesterday for 8% over four years, or 2% per year, YFA immediately responded with another good faith counter, another compromise. We keep trying. YFA had previously made compromise proposals to the District during factfinding in September and again on November 14. The District’s statement of course ignores these three compromise proposals from YFA.

In addition, the District’s statement misconstrues the upcoming strike as resulting from these negotiations. Not so. The strike is motivated by the District’s repeated Unfair Labor Practices----its illegal threats, through its Board resolutions, to fire faculty for engaging in lawful union activity and its bad faith, regressive bargaining. Not once has the District offered to talk with YFA about the causes of this strike to resolve these issues.

The District is also refusing to respond to State Senator Cathleen Galgiani’s letter demanding a written explanation for the YCCD’s bad-faith negotiations and faculty bullying tactics, nor has it ever apologize to faculty for these illegal threats.

YFA’s door always remains open for good faith negotiations and to work with the District to address these unfair labor practices, but this requires the District to participate as a good faith partner. We continue to look forward to that day.

I know alot of qualified people that would love to teach at Columbia College, too bad I wasn't in charge, these lefties wouldn't have to bother coming back to work after getting together with the rest of the Lefties in Sonora that would protest the thought of using just one square of toilet paper over three squares, you get our local kids to sign up and go there so you can have your great job, then screw them with your demands!

    Obama Used Tear Gas At Least 80 Times at Border
    Under the Obama Administration, U.S. Customs and Border Protection (CBP) law enforcement officials, including Border Patrol agents, utilized tear gas against migrants at or near the border at least 80 times between FY2012 and early FY2017.
    CBP officials reported the use of tear gas and pepper spray to push back “assaultive” caravan migrants attempting to enter the U.S. illegally on Sunday. The agency began using these particular sprays during the Obama administration in 2010.
    Breitbart News confirmed the CBP began using tear gas (2-chlorobenzylidene malononitrile – CS) in 2010, though the available usage data initiates in FY2012.
    “CBP takes Sunday’s employment of use-of-force very seriously. CBP reviews and evaluates all uses of force incidents to ensure compliance with policy,” a CBP spokesman told Breitbart News in response to an inquiry. “Over 1,000 individuals who were part of the so-called caravan attempted to cross illegally into the U.S. by breaching sections of the fence and using vehicle lanes in and near the San Ysidro Port of Entry. This group ignored law enforcement agencies in Mexico and assaulted U.S. Federal Officers and Agents assigned to respond to the situation in San Diego.”
    “As a response to the assaults and to defuse this dangerous situation, trained CBP personnel employed less-lethal devices to stop the actions of assaultive individuals attempting to break into the U.S.,” the spokesman continued. “CBP has been preparing for weeks for events like the one on Sunday. We have seen the use of violence by members of this so-called caravan who have attacked law enforcement personnel in Guatemala, Mexico and now the U.S. CBP will consider using all approved and available resources to protect travelers, caravan members, and our agents and officers.”
    The CBP use of force reports show CS tear gas used 126 times since 2012. Officials utilized pepper spray a total of 540 times during that same period.
    The current CBP Use of Force Policy handbook (dated May 2014) requires all officers and agents to be trained in the use of all weapons utilized in operations, including less than lethal devices, such as these types of sprays. It also requires the officers and agents to be exposed to the sprays as part of the course of instruction.
    During a telephone conference call with news media on Monday, CBP Commissioner Kevin K. McAleenan said, “Yesterday, U.S. Customs and Border Protection agents and officers in San Diego effectively managed an extremely dangerous situation involving over 1,000 individuals who sought to enter the U.S. unlawfully in large groups. They did so safely and without any reported serious injuries on either side of the border.”
    “As we’ve articulated for several weeks, we have been concerned about the size of the caravan, its primarily single-adult composition, and the aggressive and assaultive behavior at both the Honduras-Guatemala border and the Guatemala-Mexico border,” the commissioner continued. “U.S. government officials have noted the presence of criminals in the group, and the Government of Mexico has arrested over 1,000 caravan members for criminal violations in Mexico.”

          Drought and global warming are real and if the forests had been thinned and managed they would have been drought resistant and healthy. Think 100 to 150 trees per acre instead of an overgrown 400 per acre.         Proud retired Union. I once heard a really ignorant Republican in Murphy's on the upcoming third term of Gerry Brown. I'm not in love with Brown which is why we left your over taxed state. But my peeve is this, this ignorant republican ranted and raved how Brown was going to side with all the state unions. When there ignorant sole finished his rant and I approached him and asked which union were you in to speak of how corrupt we were. He stated he was never in a union. I then turned and went to work.
