What's in the future for Calaveras? ~ Letter To Editor By Mark Clark

Mountain Ranch, CA... Here we go again. A new election with commercial cultivation is once again on the table. The growers are going to keep on with their argument that they are all about their community and that they are doing mankind a service by providing the miracle drug, marijuana. Their sacrifice is going to provide millions to the county and we will all live in a Garden of Eden.




Well actions speak louder than words. While citizens who were concerned about the direction Calaveras is headed, worked on the petition to get Measure B on the ballot, the humanitarian growers berated and cussed at them. Their ban petition and "No on D" signs were destroyed. You didn't see any "Yes on D" signs destroyed, but we all know how that story ended. Well now they have hit a new low. While a pro Measure B supporter was attending church, let me repeat, "attending church", had the tires slashed on their car for having a " Yes on B" sign on it. Enough is enough. This behavior is exactly like the anti-Trump snowflake protesters. Allowing commercial cultivation in our county, these are the people you are going to have neighbors. You need to ask yourself a question, how much is it worth to you? How much quality of life are you willing to sacrifice? The only reason I submitted this letter to "The Pine Tree" is so they can respond anonymously and post their nasty comments below it and let their true colors come out. They will do it, it is who they are.

We now have the opportunity to be the first in the country for the people to decide whether we want commercial cultivation in our house. The previous Board of Supervisors sold us out with their "Urgency Order" and did it at the worst time after the Butte Fire. They created a monster that they have proven they have no control of. The growers argue that Measure C will provide funds to the county to weed out the "bad actors". Well who are the " bad actors"? The "commercial" grows that registered with county are failing to be in compliance with the Urgency Ordinance by two-thirds. If you are not in compliance, Measure C is not in effect. So much for that $11,000,000.00 to the county. Better check your math. My question to these " Oscar Performers" is, since you run in the same circle, how many of the "hacks" have you reported to the hotline to assist the county in getting control? Regulation will deterrent a "bad actor" as much as a "gun-free zone" sign does with a felon. The cultivators need these bad actors because there is strength in numbers. If the county adopts a permanent ordinance, they will have the political pull and money to alter the ordinance to benefit themselves in the future. They have already proven that they don't want the Board of Supervisors to have control over them with Measure "D" in November of last year.

The bottom line is, any money that Measure C generates will be tied up policing the growers and dealing with the mess it creates. The commercial growers will be the ones making the millions while the citizens of Calaveras are left holding the little plastic baggy. Now is the time finish the job and save our county. Vote yes on Measure B.

        I signed both versions of the ban petition at public events.

        No one lied to me about anything. The weed "culture" is killing out county with it greed , environmental degradation and intolerance.

        The tax money from the clearly unenforceable "regulation" of weed farms will be used to chase around the criminal "farmers" as they destroy Calaveras County.

        Only Big Marijuana will profit from so-called regulation. The rest of us will eat their sh*t.

              They all showed up in raggity clothes as if just got done planting and came to the very nice formal dinner.
              Common Grounds does a wonderful job every year and this just ruined it for me,will not be attending again.

        The paid petition gatherers for Measure D (the misleading pro-marijuana and pro-marijuana enterprise expansion initiative) falsely told multiple potential signers in various locations across Calaveras County that they were for the ban. There are several witnesses who will attest to this. So please.

      A lie is a statement the stating party believes to be false made with the intention to deceive.
      I think what the growers continue to call lies made by McManus and Tunno are/were actually their opinions.

      If you call their opinions lies then growers need to hold the mirrors up and call their own statements lies too.

      The county will NOT be overrun with illegal grows. This is an opinion, NOT a fact. It will NOT bankrupt the county to enforce a ban. Most of the registrants will leave because they will need to hustle to find somewhere else to get a local license so they can get in line to get a state license. The cost to eradicate is not a law enforcement cost. This is Code Enforcement. The BOS just passed expedited rules for Code cases. Those growers will have judgments placed on them. Deputies do not have to clean up abandoned grows. The county will not lose $11 million because that number is a huge unknown. Those and other statements by growers are LIES. We need to hurry and file a Writ to have that language removed from the ballot.

    Tuolumne and Amador counties are posturing right now to do what Calaveras has the opportunity to. Legal growers from Calaveras are buying property there and Calaveras will only be left with the outlaws, and not the hippy ones either. News will spread like wild fire that abandoned grows are set up. Who do you think is going to buy them? Sometimes it's better to know the devil you know because if it gets banned, this county will truly be filled with outlaws. Please don't mess this up by voting for a delusional ban.

    Bill and Dave lied, used deceitful tactics, enough so that the justice system stepped in, now that's telling some pretty good whoppers in my book. Kind of like when I caught this whopper of a fish, I get it to shore, beaming with pride I hold it up and the fish wiggles and I lose my grip, well this fish hits the water and when it hits the water it created a small tsunami, I swear to god it happened .....well anyway, the justice system didn't have to step in and straighten anything out, even though 6 boats sank when the fish hit the water.     Calaveras sheriff gets $32,000 illegal cannabis eradication grant

    "The Calaveras County Board of Supervisors approved a $32,000 interagency agreement Tuesday with the U.S. Department of Justice Drug Enforcement Agency to assist with illegal cannabis eradication.

    The grant extends from Oct. 1, 2016 to Sept. 30, 2017.

    Capt. Jim Macedo of the Calaveras County Sheriff’s Office said much of the funding will go toward helicopter expenses and overtime costs. He said they use helicopters during eradication for surveillance and short-term hauls, and pay overtime to deputies who participate in eradication efforts.

    The concept of funds available to enforce a ban has been a hot topic with an all-mail election looming to determine the fate of the county’s marijuana industry."

    What everyone seems to leave out is the impact to our county that WON'T be paid for by the 11 million PROJECTED dollars.... increased population means more cars, which means smog, more wear and tear on the roads, more litter. More water usage means lower water tables. Areas with large quantities of commercial growers have a documented record environmental damage. Can you say endangered species? And btw where is SIR The superintendents promised?

    And just so the residents know, the things that can't be paid for by the measure c money will be for by increased property taxes, smog requirements on our cars, and no more free use of the dumps. And if your well fries up... sorry that's on you. We all need to think ahead to the unintended consequences.

            Yeah? Well, MY dad told me if I tried to treat people decently, tried to act generously, gave a damn about my neighbors, and loved my kids, I'd eventually get where I am today:

            Unashamed of going to church;
            Unashamed of being in recovery from drug & alcohol addiction;
            Unashamed of helping my children seek recovery for their own inherited addiction issues;
            Unashamed to protect my county from predation by "farmers" who think that destroying our quality of life is an unfortunate, but acceptable, by-product of their blind greed;
            Unashamed of wanting more for the children of the families in this county-I've spent my life here, growing up and eventually raising a family of my own among my neighbors, both my friends and my "frenemies". We want more for our kids than to work in a filthy, drug ridden, low paying "industry" like commercial pot grows (might as well start growing tobacco-that has clearly made billions for the tobacco farmers and workers in the South.....).

            I am unashamed of educating myself on the REAL dangers of industrial marijuana production. It wasn't hard-just look at Humboldt, Mendocino, and Colorado.

            It's become more and more apparent to me that the weed "industry" is deeply frightened that Calaveras county voters will vote for an historic ban on their product. They're afraid that the rest of America will wake up and understand that they have a choice in their own beleaguered communities. They want to keep us all in the dark by pretending their product is harmless and innocuous, just a silly little buzz that doesn't kill anyone....

            BAN INDUSTRIAL AND COMMERCIAL MARIJUANA PRODUCTION IN CALAVERAS COUNTY.

                    Rectified potholes and increased home prices are not an indicator of cannabis success or failure. I've been to Colorado more than a few times as well. Denver is thriving due to tech and other companies moving in, millenials' newfound purchasing power, and revitalization efforts in the more challenging areas of town among other things. Regarding cannabis, they cancelled last years big cannabis festival because it had wrought too much property damage, crime, and injuries the previous year. Cannabis is not the wonder-product you'd like us to believe. Let's keep this in perspective.

    I find this whole debate fascinating. If we would just get real for a second we could solve this problem very simply. First, everyone that wants to grow Marijuana should have the proper permit. The parameters for the permit should start at the state level and each County should have a Local Enforcement Agency with certain requirements that go along with the permit. The permit should be issued after a full EIR is performed and a proper CEQA determination is made. The application should be reviewed by the Air Board and the Water Board.

    The air Board would have difficulty with the smell issue and would require the grower to a mitigated measure to make sure that no one is offended by the strong odor. The Water Board would make sure that water is contained and creates no additional damage to clean water. Once all that is completed then a permit is issued and then the enforcement agency makes sure that the rules in the permit are followed. Severe penalties and possible cease and desist orders could be issued for those businesses in violation of their permit.

    This requires coordination with the state and the Counties. One set of rules for everyone in the business. To my knowledge none of this has taken place which opens the door for CEQA challenges and other land use issues.

Colorado is having substantial problems with the quantity and severity of cartels there now. The two biggest pro-arguments are that commercial cultivation will #1 remove illegal operations and #2 bring in money. Neither of these are true. We know this.

    You are absolutely wrong in your definition of a libertarian. Wikipedia defines Libertarism as follows ( Latin: liber, "free" ) is a collection of political philosophies that uphold liberty as a core principle. Libertarians seek to maximize autonomy money and freedom of choice,emphasing political freedom, voluntary association, and the importance of individual judgment. Libertarians share a skepticism of authority and state power." Our founding fathers incorporated there healthy skepticism of state power in our constition. Libertarians are not members of the Prohibitionist Party!

        Thank you, Mr. Tryon-I appreciate your spirited response. It's a beautiful and classic example of American patriotism, to advocate so sincerely for ones heartfelt political position.

        I most profoundly disagree.

        Unbridled industry, at the expense of the average tax paying citizen, has consistently proven to be immensely destructive. Please consider, as a horrifying example, the industrial production and terrible societal cost wreaked upon our country by the American tobacco industry.

        Industry does not, and cannot, self regulate. People will do what they are allowed to do by law, and the neighbors be damned.

          No lie-imagine what the upcoming tobacco & marijuana combo cigarettes will do to our country's health-dear God! Just makes me sick to think about it! And now, nobody will have any access to affordable health insurance. We'll all be paying out the ass for these poor addicted folks to be seen at the emergency room, and then they'll die agonizing deaths because the health industry complex won't want to pay for their proper treatment.

            Let us be clear. We are not discussing the industrial production of cannabis. The maximum permitted grow is up to a half acre. Of the certified sites the average canopy coverage is approximately 15000 square feet. These are small family grows.
            Prohibition does not work. The drug most people are addicted to is alcohol. We know how prohibition worked in that instance. You mention cigarettes, yet there is no movement to ban cigarettes. Till recently the government subsidized tobacco growing. You wish to deny the concept of free will and individual choice, and in their place substitute government coercion. That is called tyranny . Tom Tryon

No, the drug most people are addicted to is nicotine. And it has killed, and is killing, and will kill, untold millions worldwide.

The vast majority of smokers don't smoke tobacco for "pleasure", and they are unable to quit smoking because they're physically addicted.

The CDC is clear: habitual marijuana use is, by definition, addictive. Why else would there exist in America thousands of barely regulated "medical" marijuana prescription "clinics"?

So, Mr. Tryon-how about the tyranny of the industrial pot growers and retail dealers, who knowingly produce and distribute an extremely addictive and hazardous controlled substance? Does it even matter to you that this so-called "industry" also ruins and despoils our public and private lands and makes our water toxic?!

Again, why not just legalize the production, distribution & use of meth? Or why don't we just deregulate the use of prescription opioids, so we can all just get them at Senders, like Tylenol? I mean, it's abundantly clear that people will only use opioids as prescribed....shouldn't be a problem there. Maybe if opioids are deregulated, then their addictive properties will somehow disappear, in a cloud of money, perhaps.....

It actually seems that Mr. Tryon sincerely believes that if marijuana makes money, than it must be good for everyone. Good for the growers and retail distributors, but lethal for addicts and our healthcare system (such as it is).

That's not "liberty", that's greed.

    The California State Water Resources Control Board is posting a series of new pamphlets, brochures, fact sheets, and guidelines covering everything from marijuana hillside grading to pesticide use.

    As the spring planting season picks up, here are ten things concerned California citizens need to know to look for in grows.

    1) FARMERS CANNOT Bulldoze Wetlands
    Any work that involves digging or heavy equipment work in a watercourse/wetland or in a location where rain could wash dirt into a year-round or seasonal creek, river, wetland, or wet feature probably requires a permit from the California Water Board.

    2) FARMERS CANNOT Dam Streams
    Placing any type of material or structure (e.g., stream crossing, culvert, water intake, dam, etc.) in a stream (either year-round or seasonal) probably requires a permit from the California Water Board.

    3) FARMERS CANNOT divert streams-
    Diverting water from a stream probably requires a permit from the California Water Board.

    4) FARMERS CANNOT BUILDM unauthorized roads-Building Roads Requires a Permit
    Building any roads, landings, terraces or other features that involve placement of earthen fill material on your land needs a permit from the California Water Board, and the project may harm water quality if not constructed carefully, subjecting you to enforcement and possible penalties.

    5) FARMERS CANNOT excavate at will-Moving Earth Requires a Permit
    Grading, excavating, or otherwise moving earth on your property may require a permit from the California Water Board.

    6) FARMERS CANNOT just dump-Keep Chemicals Out of Streams
    Using and/or storing pesticides, herbicides, fertilizers, fuel, or other chemicals on your property requires managing these materials in such a way that they will not threaten to impact surface waters or groundwater in any way. Discharging any of the materials noted above to surface water or groundwater is illegal.

    7) FARMERS CANNOT just litter-Keep Trash Out of Streams
    Generating and/or storing solid waste (e.g., amendment bags, boxes, containers, dead plant material, waste soil, etc.) requires managing these materials in such a way that they will not threaten to impact surface waters or groundwater in any way. Discharging any of the materials noted above to surface water or groundwater is illegal.

    8)IT YOU SEE FARMERS DOING ANYTHING THAT LOOKS HAZARDOUS OR ILLEGAL, CALL,THE CALAVERAS COUNTY SHERIFFS DEPARTMENT IMMEDIATELY-The farmers Fines Could Be Huge!! Get them where it hurts! Unpermited earthwork and paving by licensed or unlicensed contractors whose work affects streams and water crossings can lead to fines in excess of $10,000 per day.

    9) CALL THE SHERIFF-Fines Could Be Huge, Part 2
    Unlicensed earthwork could result in misdemeanor charges, 6 months in jail, $5,000 fine, and up to $15,000 in administrative fines for the first offense. The second offense carries a mandatory 90-day jail sentence and a fine of 20 percent of the contract price or $5,000.

    8) Enforcement Is Going Up-CALL THE SHERIFF!
    The the State of California has dedicated more than $1.5 million in 2016 and 2017 to enforcing water quality laws on cannabis growers.

    9) Report Folks Who Are Trashing Watersheds and Neighborhoods!
    The public can help by educating friends and neighbors and reporting water quality violations to the California Water Boards at: State Water Resources Control Board – Office of Enforcement Phone: (916) 341-5272, erin.mustain@waterboards.ca.gov or, you can submit an environmental complaint to Cal/EPA via the following web link.

        all of the above (violations) continue to this day. for instance: old greek mine rd, mt ranch. a large farm, pushing dirt to expand, posted threatening signs stating this is private property- on a public road, cutting a road across the neighbors property line AND crossing a major drainage. the canon booms incessantly, supposedly to scare away deer. they truly are a joy to live near. on the other side; another giant farm running a generator night and day, stripping away the very few trees that remained after the fire. please remind me how lucky we are to have these flatlanders here. welcome to calaveras, now go home.

    Yeah, so- I'm not Mark. Stop trying to be overly clever, it's above you're pay grade.

    Mt. Ranch was a lovely, rural, secluded little home place for many over the years. It's degraded beyond belief by the fire and the giant pot farms. Perhaps somebody with better tech skills than I can post some real, untouched and unbiased photos of the actual "farms" themselves, so we can all get a good idea of what we're discussing here.
