Court Rules that Ban Proponents Offered False and Misleading Ballot Arguments in Support of Measure B, Orders All Challenged Arguments to Be Changed or Deleted

San Andreas, CA...A Superior Court Judge has ruled that the authors of Measure B, Bill McManus and David Tunno, submitted numerous false and misleading ballot arguments in support of their effort to eradicate cannabis farming, even as the industry is poised to generate millions of dollars in local tax revenue. In a sweeping victory for Robert Bowerman, a longtime resident who filed the legal challenge, the Calaveras County Superior ruled on Tuesday that all eight of the ballot arguments challenged by Bowerman must be either changed or deleted before going out to voters.




The Court’s order comes after a lengthy hearing, which exposed various flaws in the ballot arguments that McManus and Tunno had tried to include in the voter information guide for Measure B. For instance, despite their claim that “illions of extra dollars to fight marijuana are available from the feds,” the Measure B authors conceded that most federal eradication money Calaveras County has ever received was a $40,000 grant in 2015. McManus and Tunno also admitted that a quote in their ballot arguments, which they attributed to Sheriff Rick DiBasilio, could not be substantiated.

Adrian Lambie, an attorney with the law firm Archer Norris, which represented Mr. Bowerman, focused on another topic. “I think one of the most important things to come out of yesterday’s hearing was the admission by Measure B’s authors that their initiative conflicts with state law, and the Judge’s observation that it will lead to more litigation and maybe even an invalidation of the entire Measure. Voters need to understand that this is a seriously flawed piece of legislation that will create far more problems than it solves. I am pleased that the ballot arguments will now reflect this more accurately.”

For his part, Bowerman feels vindicated but was quick to emphasize that he harbors no ill will towards his opponents. “I fully support Bill and David’s right to express their opinions in the voter information guide,” Bowerman said. “But this election is too important for those opinions to also include false statements of fact that could mislead voters. I am happy that the Court agreed.”

    I've been struggling with this. I would very much like to see commercial cannabis banned in our county. However, this ban Is punitive of individual rights, denys access for medical needs and lacks a mechanism for enforcement. Please give me a commercial ban that allows my neighbors to grow a few plants for personal use consistant with state law. That allows those with real medical needs reasonable access to dispensaries. That rasies sales or property taxes so there's actually revenues for enforcement. I would be willing to pay for that. What we really don't need is commercial cannabis or this poorly written, vindictive diatribe. Let's get a legitimate ban written, properly funded and move forward to a better Calaveras.......

It does bring in the money and since we've had growers here for decades, it's also keeps them employed and busy.

      Sadly both sides of this issues have misrepresented. I remember talking with a D proponent last year. She said "I was told by them (the D proponents) . . ." I learned she had not actually compared the UO to D. So, I did it for her and gave her the 'accurate' information on how the UO and D were different. She ended up voting No on D.
      The Alliance was allowed by D. Ponte to have far too much influence in the writing of UO. Bowerman tried to pull one over on us with D. Now we have a ballot initiative that is badly written. I really don't understand why none of these people, who talk with attorneys, law enforcement, etc., can't get something with which we all can live and flourish. .I don't support commercial grow activities in the County. I do support medical grows, but not the 1/2 acre we've got with the UO. Hopefully the new BoS, assuming B fails, will provide a viable ordinance. They're divided though and it's doubtful they will come up with anything that protects non-growers and growers alike. Just look on how the UO extension vote went.

      It would help if some of those with so much time on your hands would go to the source documents instead of reading (and believing) a half-ass (and contextually wrong) Wikipedia article. The DEA 2016 budget states very clearly that it was budgeted a little over $2 billion for its total budget with $1.6 billion allocated for domestic operations which is almost entirely taken up by salaries and expenses for DEA agents, intelligence analysts, and information center operations. Only about $4 million is allocated for state and local assistance, about half of which is for DEA civilian employees. Stop blowing hot air. We need clarity, not wishful thinking.

I've been in between this for some time. I see the good and bad in having commercial growth in our county even though marijuana has been here for a long time being in the illegal form. Now the state has allowed anyone of age to legally grow a few plants for their personal use.
To be quite honest with you, when an opponent knowingly falsifies facts, what that opponent is doing to you is he's lying to you, plain and simple and that's a fact To put it simply, after these elections I'm tired of the dirty campaigns and the lying, if you're lying about something, that just makes you a dishonest person and a dishonest way to get what you are after, I guess you can say then you have become a corrupt person for lying to try to get your way.
Well since being in between how to vote, looking at the good and just a few things I didn't think were good, I'm going to cast my vote towards legal growth. I think when an opponent has to resort to dishonesty, I will not back you. Sorry but I wouldn't trust anyone who lies to me, you can all back a liar, dishonest, corrupt person/s if you wish, but you might want to keep a close eye on them when ever they're around. As for myself, I want no part of them and what they stand for.

          No it only allows for people with tens of thousands of dollars to build a seperate structure to grow indoors, have high electricity bills, and have to purchase thousands of dollars worth or indoor growing equipment. Everyone else is disallowed by this idiotic measure. Bill and David have lied and lied and lied and lied and now everyone knows. Shame to both of them. They should be embarrassed and humiliated.

And look of all the benefits alcohol has.....um, it helps you dance better, sing better, and you become smarter with every drink. On the medicinal side...um....you see your Dr more....because of all the side affects with addicted drinking does to you. huh? I've never heard of those great side affects with marijuana.
