Local Resident Challenges Measure B Authors Bill McManus & David Tunno For “Misleading” Voters

Calaveras County, CA...Local resident and former candidate for County Supervisor Bob Bowerman filed a petition for a Writ of Mandate in Calaveras County Superior Court on Thursday alleging eight “false and misleading” statements in the ballot arguments in favor of Measure B, a ban on medical and commercial cannabis cultivation in Calaveras County.



Bowerman alleges that McManus and Tunno continue to make false statements in public filings, as well as in public settings.

California Elections Code section 9190 allows voters to file a “Writ of Mandate” to challenge information submitted for ballot pamphlets, which are delivered to voters in advance of an election. According to the law, statements which are “outright falsehoods or objectively untrue” can be stricken from ballot arguments. The filing does not require any financial obligation from McManus or Tunno, as it is strictly an effort to ensure that voters do not continue to be misled by false information.

“Frankly, I’ve had enough,” Bowerman said of Tunno and McManus’ comments. “The voters deserve to know the truth in order to make an informed choice.”

Contested points made by Measure B authors include the claim that regulation brought cannabis to Calaveras County. In fact, Calaveras officials and satellite images confirm the existence of cannabis cultivation in Calaveras for decades.

Another claim Measure B’s authors continue to make is that top law enforcement officials are universally for a ban. This has been proven untrue; Calaveras County Sheriff Rick DiBasilio has publically stated that he will not have the funding needed to enforce a ban should voters enact it.

False claims from Measure B’s authors conceal the impact of Measure B on Calaveras. There is no question, Measure B:

- Eliminates funding for law enforcement.

- Closes dispensaries in Calaveras that provide medication to sick patients.

- Immediately eliminates at least 2600 jobs, and likely an additional 800 related jobs.

- Makes Calaveras less safe by forcing legal cannabis farmers out, and inviting illegal growers in.

    2600 jobs for out of state out of country non community members, ok 2500.....ummmm we know there was pot here before, but this is different. Before we could walk our grandchildren down our road, now we cant, i told them all not to visit at harvest season. Different. Bad. How dare uou tell me its ok. We can decipher the truth without even reading the ban. We live it in our neighborhoods. Voting to ban no matter what nasty little fights you all get on, no matter what amount of drug backed money on advertising.

        The sheriff was quoted as saying that we should not let our kids outside during the two months of harvest! And everyone fires guns daily so people will know they are there, and armed! The influx of people living rough is very stressful, Bad!

    unfortunately if we ban it, we will be screwing ourselves. i'm not for coddling this new reality, but it is here for good now. we must find a way to control it rather than it controlling us. please study the ban initiative, and realize what its passage will mean to law abiding citizens. there won't be any enforcement pretty much whatsoever. the asian cartels will take over D-2 at a minimum. please study the issue and vote intelligently. many of you will know who posted this. i'm not going to post my name so i won't be again threatened with death by the asian gangs like i was last year. please vote no on the ban. if it is banned, the gangs will invade this county. this isn't about greenhorn creek, la contenta, or other subdivisions, this is about the back country. we will be overrun without law enforcement, regulation, taxes. its time for law abiding citizens to take back the county. unfortunately it can't be done by banning. we must regulate heavily. again, please study the ban, and its ramifications, then vote no on b. thank you

How come Bob did not file for a writ of mandate with the discrepancies involved in Measure D? Please understand Bob. The Voter's of Calaveras County are very intelligent people. They can read through the lines. They are capable of understanding what is best for the area. They have lived with the fall out of the regulations. Thank you for your input. But, if you wanted to be respected in this county, you would not provide biased opinions. You would have spoken out on Measure D as well and pointed out the issues there as well.

So far, the only things I have found are pro-cannbis. The study paid for by a grower, and done by UOP is one sided and only states what money it might bring to the county with nothing on the costs, both financial and social, it will also bring. It is time for a well rounded study to be done independently, letting us all know the pluses and minuses of commercial growing on our county.

    only cost to county from Marijuana is the $22,000.00 we had to spend on a special election. The claims that this measure B protects patients rights is complete BS when it forces all dispensaries to close and people to build a special room to grow their personal state allowed medicine. the State allows 6 plants this measure B only allows 3. No safe access no personal grows & no Commercial Growing for those who can't grow for themselves? NO on Measure B collect the taxes fund schools & law Enforcement!
