Local Resident Challenges Measure B Authors Bill McManus & David Tunno For “Misleading” Voters

Calaveras County, CA...Local resident and former candidate for County Supervisor Bob Bowerman filed a petition for a Writ of Mandate in Calaveras County Superior Court on Thursday alleging eight “false and misleading” statements in the ballot arguments in favor of Measure B, a ban on medical and commercial cannabis cultivation in Calaveras County.

Bowerman alleges that McManus and Tunno continue to make false statements in public filings, as well as in public settings.

California Elections Code section 9190 allows voters to file a “Writ of Mandate” to challenge information submitted for ballot pamphlets, which are delivered to voters in advance of an election. According to the law, statements which are “outright falsehoods or objectively untrue” can be stricken from ballot arguments. The filing does not require any financial obligation from McManus or Tunno, as it is strictly an effort to ensure that voters do not continue to be misled by false information.

“Frankly, I’ve had enough,” Bowerman said of Tunno and McManus’ comments. “The voters deserve to know the truth in order to make an informed choice.”

Contested points made by Measure B authors include the claim that regulation brought cannabis to Calaveras County. In fact, Calaveras officials and satellite images confirm the existence of cannabis cultivation in Calaveras for decades.

Another claim Measure B’s authors continue to make is that top law enforcement officials are universally for a ban. This has been proven untrue; Calaveras County Sheriff Rick DiBasilio has publically stated that he will not have the funding needed to enforce a ban should voters enact it.

False claims from Measure B’s authors conceal the impact of Measure B on Calaveras. There is no question, Measure B:

- Eliminates funding for law enforcement.

- Closes dispensaries in Calaveras that provide medication to sick patients.

- Immediately eliminates at least 2600 jobs, and likely an additional 800 related jobs.

- Makes Calaveras less safe by forcing legal cannabis farmers out, and inviting illegal growers in.

It is true that B has lots of holes in it. And even further, MJ has been here for ages and a ban would not stop growers.

So forget the ban and allow our new Sups to make regulations that can control its growth.

Ban and deport all people who moved to Calaveras County after 1985. You are stinky, you smell, you ruin everything you come into contact with or want to change, you brought your Liberal ideals and ruined the entire county and you brought more crime with your off spring you have sired. The county was just fine with out you. It will still be just fine with out you.

Ignorant, uneducated and apparently quite angry with all the new residents recently settling into his community, well kind of new anyways, if you were living somewhere other then Calaveras County or purhaps you were born here after 1985 then get out....... locals only! We want to be left alone to parish alone with our failing economy, please don't bring prosperity or hope of revitalizing our community. We like living in a world with empty store fronts and no possible hope for our children to prosper in the same area they were raised. Go Away...... what an ass----!

To posters on this site (and others) who are in favor of regulation and oppose measure B:
If it's your intention to advance a pro-regulation position, please... Don't be drawn into petty squabbling and name calling. You gain nothing by hurling insults at those with whom you disagree. Disagree with the position, not the person who holds it.

If you want to make inroads with people on the other side of the discussion, you will have greater success by treating them with respect. Show them that you are in fact the kind of person they would be glad to have as a neighbor. the kind of person who respects them despite a difference of opinion on a particular subject.

We have more in common than what appears to separate us. We all want a lot of the same things.... A healthy and prosperous environment for ourselves, our children and our neighbors, in the present and future.

Don't act like the people your detractors portray you to be.

That is not possible. It would be like trying to ban grapes, walnuts, and eggs. Acceptance of what is is the only thing that will lead you out of your own filthy ignorant fearful narrative about the world which you think you are the center of. Real life awaits you. Take a deep breath now and just let you all your fear and anger go.

Before we could walk our grandchildren down our road, now we cant, i told them all not to visit at harvest season. Different. Bad. How dare uou tell me its ok. We can decipher the truth without even reading the ban. We live it in our neighborhoods. unfortunately if we ban it, we will be screwing ourselves. i'm not for coddling this new reality, but it is here for good now. we must find a way to control it rather than it controlling us. please study the ban initiative, and realize what its passage will mean to law abiding citizens. there won't be any enforcement pretty much whatsoever. the asian cartels will take over D-2 at a minimum. please study the issue and vote intelligently. many of you will know who posted this. i'm not going to post my name so i won't be again threatened with death by the asian gangs like i was last year. please vote no on the ban. if it is banned, the gangs will invade this county. this isn't about greenhorn creek, la contenta, or other subdivisions, this is about the back country. we will be overrun without law enforcement, regulation, taxes. its time for law abiding citizens to take back the county. unfortunately it can't be done by banning. we must regulate heavily. again, please study the ban, and its ramifications, then vote no on b. thank you

How come Bob did not file for a writ of mandate with the discrepancies involved in Measure D? Please understand Bob. The Voter's of Calaveras County are very intelligent people. They can read through the lines. They are capable of understanding what is best for the area. They have lived with the fall out of the regulations. Thank you for your input. But, if you wanted to be respected in this county, you would not provide biased opinions. You would have spoken out on Measure D as well and pointed out the issues there as well.

So far, the only things I have found are pro-cannbis. The study paid for by a grower, and done by UOP is one sided and only states what money it might bring to the county with nothing on the costs, both financial and social, it will also bring. It is time for a well rounded study to be done independently, letting us all know the pluses and minuses of commercial growing on our county.

only cost to county from Marijuana is the $22,000.00 we had to spend on a special election. The claims that this measure B protects patients rights is complete BS when it forces all dispensaries to close and people to build a special room to grow their personal state allowed medicine. the State allows 6 plants this measure B only allows 3. No safe access no personal grows & no Commercial Growing for those who can't grow for themselves? NO on Measure B collect the taxes fund schools & law Enforcement!

We the voters know what we want, and the tally provides the result. End of story. Who the hell are you to assume we are so stupid that we can't analyze data and form our own opinion? We are just fine with the information provided before the vote. Given the opportunity, we would cast the same ballot again.

Bowerman....do you realize how stupid you look when whining at the BOS
meetings. You think your so intelligent when speaking but most are laughing behind you back. Play the videos back and amuse yourself.
You lost the election. You smoke weed. Your hair needs washed. You probably qualify for welfare from the way you look and speak.
Bow out of the issue pot head. Your a looser just like the election proved!
