Wild & Scenic & Water Rights ~ Letter To The Editor By Mike Preston

Arnold, CA...(Originally Sent To Enterprise) I’m writing to you today in response to your recent Poll Results regarding the attempts to strip the residents of Calaveras County of their water, and water rights with the proposed designation of the Mokelumne River as ‘Wild and Scenic’. Try as I may, I find it virtually impossible to accept your poll results as being even remotely accurate and a ‘true representation of the thoughts and wishes of the residents of Calaveras County’....



In your Poll you have indicated that the vast majority of the residents want
to receive this designation along with the permanent loss of our water and
future water rights which I find very difficult to fathom. Was this a
scientific poll? If so I did not notice any data indicating the margin of
error, etc. No one’s name is on it .

I was initially excited to hear you had a new Editor in Chief on ‘board’
from New York with the hope that we would once again have an unbiased news
outlet that would have the best interest of the residents and the community
in mind. Evidently that is not the case. The residents of Calaveras County
want a news outlet that accurately ‘reports’ the news, not fabricates it.

If you want to see just what the California Water Code has to say about the issue
just google up the following sections and statutes;

Fienbaum Act 1927 CWC 10500-507.
County of origin act 1931.
Area of origin act 1933.
Watershed Protection act CWC 11460-463
Burns Porter act 1959 CWC12931.
Opinion No. 53/208 By Edmund G. Brown Calif. AG 1/5/55.
CWC sections 10505, 10505.5, 11128, 11460-11463, 11128,12200-12220.
10504-10506.

These are the law, so will they be ignored or repealed what? Has our rule
of law passed by the duly elected representatives just being ignored in
favor of the weight of a imbalanced populous no matter how wrong and unjust
it is ?
