SUMMARY OF THE MINUTES OF A REGULAR MEETING OF THE BOARD OF SUPERVISORS, COUNTY OF CALAVERAS, STATE OF CALIFORNIA HELD ON MARCH 15, 2011

PRESENT: Thomas Tryon, Chair; Gary Tofanelli, Vice-Chair; Steve Wilensky, Merita Callaway and Darren Spellman, Supervisors; James Jones, County Counsel, Jeanne Boyce, County Administrative Officer and Diane Severud, Supervising Board Clerk

CONSENT AGENDA
Consent Agenda Item 3 was pulled by Supervisor Spellman and Item 4 was pulled by Supervisor Wilensky. The balance of the Consent Agenda was unanimously approved on a motion by Supervisor Spellman and a second by Supervisor Tofanelli.

1.MINUTES of a regular Board of Supervisors meeting held on February 22 and March
1, 2011
2.CORRESPONDENCE:
February 18 – March 3, 2011
5.MINUTE ORDER authorizing a release of the remaining balance of Inspection Fees
in the amount of $5,238.86 to Calaveras Public Utilities District. Approved 5-0.
6.MINUTE ORDER authorizing applications fees in the amount of $14,002.50 be refunded to applicant Richard Basford for Project Number 2009-013 ZA/TPM.
Approved 5-0.
7.RESOLUTION to waive certain eligibility requirements of the “Rental Security Deposit Revolving Loan Account” Program to allow an employee of Calaveras Works and Human Services Agency to receive rental security deposit loan assistance in the amount of $1,000.00. Approved 5-0.
8.RESOLUTION approving the Calaveras Works and Human Services Agency’s – Child Welfare Services Self Assessment Plan for Calaveras County for May 2, 2011 through May 3, 2014. Approved 5-0.
3.RESOLUTION authorizing changes to the Position Control List. Approved 4-1, Supervisor Spellman dissenting.
4.RESOLUTION recognizing the contributions of the Mountain Ranch Community and
assuming maintenance responsibility for the Mountain Ranch Community Bus Shelter.
Approved 5-0.

REGULAR AGENDA
PUBLIC COMMENTS: Bill Smith, Mtn Ranch, commented on the buyer and seller process as related to prescriptive easements. He stated that there is no treated water orsewer in Mtn. Ranch and applying for a permit is confusing. George Fry, Angels Camp, reported that it Sunshine Week; a time when California acknowledges The Brown Act. Al Segalla, Calaveras County Taxpayers Association, commented that the legal access issue is a mistake that happened previously and needs to be corrected. He is concerned about CalPERS issues and has met with County officials and in his opinion, the Supervisors have a fiduciary responsibility to the people to recognize the conflict of interest associated with them making decisions about their own retirement. Marilyn Connor, One Stop Manager for Job Connection Calaveras, reported on legislation to eliminate the Workforce Investment Act and therefore the One Stop Centers.

She is working with several departments to provide job seeking assistance. Bonnie Newman, Double Springs, announced a presentation tonight for “Caregiver 101” and that SEIU will be there to answer questions. She also announced that March is National Colo-rectal Awareness Month. Terry Baker, Rail Road Flat, he stated that he agrees with others regarding the Brown Act needing to be open to everyone. He has a 12 page letter to the DA, with copies to the others regarding his opinion about the
County’s numerous violations. Joe Kelly, Copperopolis, stated that every day used to be Sunshine Day and that changed in 2003 when an Attorney General made changes that gave exceptions to certain agencies and procedures.
10.MINUTE ORDER approving contract amendment for PSA Dewberry in the amount $32,475 for additional services for the Adult Detention Facility and Sheriff’s Administration Building. Elderberry Re-design tabled for two weeks, Approved 4-1, Supervisor Callaway dissenting. On-hold costs, Approved 5-0.

11. Index 3 - MINUTE ORDER approving the Plans and Specifications for the project entitled O’Byrnes Ferry Road Bridge Emergency Repairs, dated January 2011.
Approved 5-0.
12. RESOLUTION authorizing two Applications for Grant Funds from the State Bicycle Transportation Account in the total amount of $1,365,350. Approved 4-1, Supervisor Spellman dissenting.
13. Informational Briefing: Adult Detention Facility and Sheriff Administration Building Bid Award Process.
14. Review of correspondence, reports and various matters of concern. Supervisor Spellman will hold his usual constituent hours. Supervisor Tofanelli will attend the CAMRA meeting, will speak at the Valley Springs Area Business Association luncheon, attend a meeting for the Delta College Committee and CCOG. Supervisor Callaway, with the Board’s approval, will work with staff to draft a letter of support for the Calaveras Arts Council for a Grant Application, She inquired if the Item 5 reimbursement to CPUD amount should be re-evaluated since it had been many years at the same dollar amount. She attended the Area 12 State Audit of the agency, and will attend the Greater Arnold Business Association, CSAC Technical Committee Public Safety Conference call. Supervisor Wilensky will attend the Amador Calaveras Consensus Group meeting, the Delta College Committee
meeting and the Sierra Nevada Forest and Communities meetings. He reported that, many Joint Power Authority agencies may experience reduction in services due to possible lack of funding. Chair Tryon will attend CCOG on Thursday. He asked the opinion of Board regarding limiting Public Comment to three minutes for the Hearing later today. The Board supported his decision as the Chair. Callaway asked CAO Boyce to extend her compliments to Mary Sawicki for her excellent work on the peer review. County Counsel Jones had nothing to report; however, he asked that Closed Session Item 16 be cancelled due to the prematurity of the item. The Board agreed. CAO Boyce reported that next week’s meeting will include a presentation by Public Works regarding the Gas Tax Swap Reinactment and at 1:30 PM that day there will be a CalPERS presentation. She gave an update on the continuing State Budget negotiations, the meeting of the CSAC and LA County representatives with the Governor regarding numerous suggested changes to the budget, but the lack of votes to go to the voters at this point. Redistricting and Census information workshops. She reported on the staffing issues facing the Treasurer-Tax Collector and Clerk-Recorder offices and that she had authorized a
part-time Tax Technician position for the Treasurer-Tax Collector and a full-time Recorder for the Clerk-Recorder. Both continue to have additional unfilled vacancies.

The Board recessed at 12:05PM and reconvened at 1:30PM.
15.PUBLIC HEARING and possible Board action re: Negative Declaration, Title 17 Zoning Amendments and Denial of Project 2010-031. Failed 2-3, Supervisors Callaway, Wilensky and Tryon dissenting.
16.CLOSED SESSION: conference with legal counsel; anticipated litigation B significant exposure to litigation (one case), pursuant to Government Code section 54956.9(b)(1). Cancelled at the request of County Counsel.
