COUNTY OF CALAVERAS, STATE OF CALIFORNIA
HELD ON November 16, 2010

1. MINUTES of a regular Board of Supervisors meeting held on October 26, 2010–Approved 4-0-1 ABSENT: Callaway 2. CORRESPONDENCE: October 29 thru November 4, 2010, Approved as processed, 4-0-1 ABSENT: Callaway 3. RESOLUTION establishing the FY 2010/11 schedule of fees for land classification for property related Solid Waste Parcel Fees; Approved 4-0-1 ABSENT: Callaway 4. RESOLUTION vacating a public road easement known as Tad Way; Approved 4-0-1 ABSENT: Callaway

5. PUBLIC COMMENTS: Marti Crane, Valley Springs, addressed the Board regarding the holiday season and the increase in suicides. Announcement made for participation in the Valley Springs Turkey Trot and the success of Dancing with the Sierra Stars benefiting Mark Twain St. Joseph Hospital projects. Captain Jim Macedo stated on November 29th, the Sheriff’s office will begin on-line reporting increasing efficiency and cost savings. Lynn Epler and Tim O’Bryan, Rancho Calaveras, expressed concerns regarding their terms of office on CSA #1. Chair asked Supervisor Thomas to meet with County Counsel to review the situation. Darryl Rusk, Burson presented the Board of Supervisors with the East Bay 2010 Water Report and announced the Camanche Regional Park Advisory Board meeting on November 18th. Tom Liberty, Mountain Ranch, referenced last weeks meeting concerning a code for medical marijuana. Rosemary Wilson, Mokelumne Hill referenced the public comments procedure to introduce the medical marijuana ordinance. Clyde Clapp, Valley Springs spoke of public comments concerns and how regulations and guidelines will be conducted for marijuana plants. Joe Kelly, Copperopolis expressed concerns for the order of speakers relating to staff comments for the medical marijuana ordinance. Chair Tryon explained the procedure. Bonnie Newman, Double Springs expressed concerns regarding suicide. Possibilities were stated for tendencies that may indicate potential health issues. 6. Discussion and possible action re: the introduction of ordinances (2) adopting the California Code of Regulations Title 24, 2010 edition and amending Title 15 and the California Building Code relating to the repair and reconstruction of damaged buildings and the placarding used to denote conditions relating to continued occupancy of buildings; Approved 4-0-1 ABSENT: Callaway 7. Discussion and possible action re: a MINUTE ORDER approving contract amendment for PSA Dewberry in the amount $84,944 for Architectural Additional Services Off-Site Improvements Bidding Package for Adult Detention Facility and Sheriff’s Administration Building; Approved 4-0-1 ABSENT: Callaway 8. Discussion and possible action: re: a MINUTE ORDER approving contract amendment with Kitchell CEM in the amount $55,110 for Project Management Additional Services Off-site Improvements Construction Package; Approved 4-0-1 ABSENT: Callaway 9. Discussion and possible action re: RESOLUTION approving the submittal of the Adult Detention Facility Project Staffing Plan and Operation Cost Statement and Supplemental Report to the State Corrections Standards Authority; Approved 4-0-1 ABSENT: Callaway 10. Discussion and possible action re: appointment of member to the Assessment Appeals Board to fill the Member 3 position under the authority of R&T Code 1622.1 & 1622.2, Calaveras County Ordinance 2966 and Resolution No. 09-135; Continued to December 14, 2010; Continuance to December 14, 2010; Approved 3-1-1 NOES: Thomas ABSENT: Callaway 11. Discussion and possible action re: the appointment of applicants to serve on the Commission on Aging; Appointment of the following: District I, Don Amo for a term to 12/31/13; District I, Darryl Rusk an alternate for a term to 12/31/11; District II, John Regalado an alternate for a term to 12/31/11; District V, Helen Bravo for a term to 12/31/13; Approved 4-0-1 ABSENT: Callaway 12. Review of correspondence, reports and various matters of concern. Supervisor Thomas attended the opening of Mountain Oak Health Center. The volunteer run center will provide health care for those regardless of medical insurance. Supervisor Tofanelli had nothing to report. Supervisor Wilensky will attend the following meetings: today, Farm Advisory, Wednesday, Amador Calaveras Consensus, Thursday, steering committee, emergency preparedness and Monday JPA Central Sierra Child Support. Supervisor Tryon reported on a CCOG meeting he attended. The Board of Supervisors had requested the Public Works Director meet with the CCOG director regarding the transfer of projects. Tryon stated the matter is continued to December 8th. Today is the deadline for public member applications on the CCOG. The manner to determine representation for public members was discussed. Tryon referenced the Wagon Trail Project for Highway 4 and the potential conflict regarding the location of his family ranch business. County Counsel Jones stated the situation may be an indirect relationship between a governmental action and a possibility of an economic benefit of $20,000 or more. This would be under the Fair Political Practices Commission authority. Supervisor Tryon stated, for the record, those using the ranch for equestrian purposes ride on the ranch and not on the highway. Suggestion made to limit public comments to fifteen minutes per topic. CAO BOYCE will contact other counties for their policy information and return to the Board. A reminder of the cancellation of the November 23rd and 30th Board meetings and the first three days next week are furlough days. On December 7th there will be a study session regarding water issues and one for possible sties for the animal shelter. State budget updates was discussed regarding a special Legislative session on December 6th when the new Legislative members are seated. Local jurisdictions concerns regarding Propositions 22, 25 and 26 was discussed. County Counsel Jones had nothing to report. 13. A CLOSED SESSION was held pursuant to Government Code section 54956.9 (c); conference with legal counsel; anticipated litigation – initiation of litigation; (one case); County Counsel–By a unanimous vote, with Supervisor Callaway absent, the Board authorized County Counsel to join Calaveras County as a party plaintiff in the matter of County of Sacramento, et al. v. State of California, Arnold Schwarzenegger, et al., Sacramento Superior Court Action No. 34-2010-00090983.
