CALAVERAS COUNTY MISSION STATEMENT
The Mission of Calaveras County Government is to provide service, infrastructure, leadership, and vision necessary to advance a safe community, maintain a high quality of life, while preserving local history and culture, and to protect personal liberties for all of its citizens.
Pursuant to Government Code 65009, a legal challenge to any of the projects described below may be limited to addressing only those issues
raised at the public hearing or in written correspondence delivered to the Planning Commission at or prior to the public hearing.
The Planning Commission agenda is posted on the county webpage at www.co.calaveras.ca.us. Applications, environmental documents, staff reports, and project files are available for review at the Calaveras County Planning Department on Monday through Friday, 8:00 a.m. to 4:00 p.m., except County holidays. Copies of the file documents, including the staff report and/or environmental reviews, may also be purchased.
Planning Commission decisions can be appealed to the Board of Supervisors. Appeals must be filed with the Board Clerk within fifteen (15) days of this hearing. For more information, contact the Board Clerk's Office At 209-754-6370.
The commission may adjourn for lunch at 11:30 a.m.

1. APPROVAL of MINUTES from the August 6, 2009 Planning Commission Meeting.

E. PUBLIC HEARINGS:
1. 2004-114 NEMEE - (3) APPEALS OF STAFF DETERMINATIONS RELATIVE TO INTERPRETATION OF CALAVERAS COUNTY ZONING CODE REGARDING THE RIDGE AT TRINITAS GOLF COURSE FACILITIES AT 9209 OSPITAL ROAD, VALLEY SPRINGS (continued from July 16, 2009). As a follow-up to the denial of the application from Michael and Michelle Nemee for a Zoning Amendment, Tentative Subdivision Tract Map, Conditional Use Permit, and Administrative Use Permit for the subject property, Interim Community Development Director Brent Harrington issued a letter to the applicants on May 15, 2009, explaining the impacts of that decision on the applicants’ property (aka The Ridge at Trinitas) and uses permitted under the existing General Plan land use designation (Natural Resource Land - Agricultural Preserve) and County Zoning Code Section 17.18 (Agricultural Preserve). The property is located on the east side of Ospital Road, approximately one and one-half miles north of State Highway 26 and three miles south of State Highway 12. (APNs 050-052-041 and 050-052-042 are portions of the North ½ of the North ½ of Section 12, a portion of the South ½ of the Northeast ¼ of Section 12, and the Northwest ¼ of the Southeast ¼ of Section 12; Township 3 North; Range 9 East; MDM). Three (3) appeals to staff’s interpretation of those uses have been received, specifically as they relate to the following:
1) Appeal by Ellman, Burke, Hoffman, and Johnson, as legal counsel for and on behalf of Michael and Michelle Nemee, regarding use of the golf course (golfing on the premises) and legally permitted uses on property with a zoning designation of Agricultural Preserve.
2) Appeal by Mark V. Connelly, as legal counsel for and on behalf of Keep It Rural, Calaveras (KIRC), regarding staff’s interpretation that the use of the subject property is distinct from the physical aspects of the property (e.g., the golf course is landscaping; use of the land for a golf course is allowed so long as no golfing occurs).
3) Appeal by John Buckley, Executive Director, on behalf of Central Sierra Environmental Resource Center (CSERC), regarding staff’s interpretation that: (a) the physical aspects of the golf course are considered to be landscaping and that, due to that interpretation, (b) the County does not have the legal authority to require removal of the physical aspects of the golf course, so long as golfing on the course does not occur.
