Calaveras County Board of Supervisors Adopts a Ban Ordinance on Cannabis Cultivation ~ Timothy Lutz Calaveras CAO
San Andreas, CA...During the Special Meeting on cannabis held yesterday, January 10, 2018, the Calaveras County Board of Supervisors adopted a ban ordinance on the cultivation and commerce of cannabis within the County’s unincorporated areas. The ordinance limits the cultivation of cannabis for commercial and medical use to the limits imposed by California State law, which includes cultivating no more than six live cannabis plants per residence. Any cannabis grown within the legal limits of California law must be screened from public view and secured with child resistant locks.
The temporary permits issued under Calaveras County’s urgency ordinance shall automatically terminate within 90 days of the effective date of the ordinance. Growers who were previously allowed to cultivate cannabis under the urgency ordinance must restore the cannabis cultivation site to its former state within 24 months, including ensuring permits were completed and filed for any grading or water diversion activities conducted on the cultivation site.
The Board of Supervisors also authorized County staff to bring back for the Board to consider two measures for the June 5, 2018 election – one measure for a Countywide ban on cannabis cultivation and one for a regulatory ordinance. The scope of any regulatory ordinance for the ballot measure will still need to be defined by the Board of Supervisors at a future meeting date.
